DCA cases reversing or affirming judges' rulings in this circuit:

Every Thursday the 4th DCA issues its opinions.  I will try and post 4th DCA cases that reverse or affirm judges’ rulings in this circuit. I will not post PCAs. I will eventually elaborate on the opinions in my case law update section of JAAB:

St. Fort v. State, DCA case number: 4D04-2089; L.T. case number: 03-10662CF10A: Judge Cohen is reversed for failing to grant a judgement of acquittal on an aggravated stalking count where St. Fort was also convicted of battery and assault and those crimes formed the basis of the stalking.

State v. Cromartie, DCA case number: 4D05-1568; L.T. case number: 04-22513CF10A: Judge Murphy is reversed for granting a motion to dismiss an exposure of sexual organs case. Cromartie was masturbating in his infirmary cell and Murphy erroneously found that this was a "public place" under the statute.

State v. Gomez, DCA case number: 4D05-3094; L.T. case number: 04-4676CF10A: Judge Lebow’s ruling granting a motion to suppress identification is upheld.

State v. Santiago, DCA case number: 4D05-3389; L.T. case number: 04-13377CF10A: Judge Gold case. Santiago made contact with the clothing of a girls buttocks. He made no statements before or after the contact. Judge Gold granted a "C4" motion to dismiss. Because intent is always a jury issue, Gold’s decision is reversed.
