It's no secret that many lawyers under the old system of political patronage used to milk the system. Remember the many problems with the so called "Wheel". It's certainly no supprise that the secretary of the BACDL shouldn't also be one of them. Broward has always been the biggest offender in the state with regard to cost overages in this respect. The thing that is somewhat supprising however is that BACDL would take the tact of trying somehow to put a different face to the issue when this kind of thing comes to the surface. A few of the not so old guard are just trying to get away with this nonsense before the entire system is changed and they won't be able to carry on business as usual. All a handful of people have been concerned with over the years is lining their own pockets at the taxpayers' expense. This subject incident just brings out into the light somethingelse that has been going on for a long time. Too long.

This is a classic quote. If you cant defend Barry's numbers could you please defend as Chief Public Defender which under the Constitution is a full time job you can;
a) Be out on in front of Jimmy's every afternoon being interviewed during the Anna Nicole saga?
b) getting paid 50k a year to work at Chan 7 when you are supposed to be a full time employee?
c) Be able to teach a class at American Heritage in the morning during the school week.
Last I checked at my goverment"full time" job you worked 9-5 on the tasks of that job. You want to blast Barry about his fees, it looks like your "moonlighting" on the taxpayers dime is as much or more of a waste of tax payers money. By the way when was the last time you actually tried a case or got paid a fee from a client? I would guess it was around the time Don Johnson was cool driving around in a white Ferrari with Tubbs.

Butin is but the tip of the iceberg as far as this goes. Broward has always had major problems with costs for SPDs because the system was rotten and cases would go to friends and kin and political cronies. Some members of BACDL were part of this puzzle reaping the benefits of political patronage. Others served on judges' re-election commitees and the like. Everybody knows who they are. The same ones that think judges can do no wrong and scurried around doing their bidding. There will always be people like this. That is the truth of the matter. But in a larger view things are changing here in Broward and these people will just not be seen or heard from as much as when politics ruled unopposed and the few got away with a lot more than they seem to now. Butin knew all he had done was flatly nothing for fourteen months and in the end put in a problematic bill for nineteen grand. It was just a move of sad desperation as the last of the giveaway days evaporate and hopefully a new day is arriving that brings back good conscience to an honorable profession.
Howard's statement addresses in truth what is widely known in the state's capital and throughout Florida. Why is it that when someone speaks the obvious truth, there are those that consistently take issue with it and attempt to defend the indefensible if not for the hidden motive of personal gain. I applaud Howard for speaking to the truth of what has been a problem in Broward for far too long, and ask those that want to be critical what they hope to accomplish by condeming someone who is trying to do something about rectifying the problem. Can you not be equally productive in being part of the solution?
Hey, Ahearn, how do you defend these abuses? The numbers speak for themselves. How do you explain this article about Butin?
Maybe if we had a strong defense bar that resembled the one in Miami we could actually make an impact. Instead we have a bunch of judicial lapdogs (BACDL)that can't think beyond the end of their noses and continue to exacerbate the problem because they can't think outside of the box. Break the mold and actually take a leadership role in solving the problems that present themselves or resign yourselves to a much different pattern of events looming on the horizon.
As I said in the other thread (Justice Lewis) here is my question in all of this....
The JAC agreed to the bill for 19k and the Judge cut the bill. Seems to me if the JAC had such a problem they had a leagl forum in which to contest the bill and they failed to do so. Seems odd that instead of fighting the Barry's bill they called Help Me Howard. Like most Broward residents know, you call Help Me Howard for help before the resolution of the matter.
Korda might have taken a powder a long time ago and spared us the embarrasment. There seems to be alot of hangers on sticking around untill they have no choice in the matter.

The JAC is who brought it to the attention of the ISC so obviously they were seeking a resolution to the matter. Gardiner just did what she felt was the proper thing to do under the circumstances.
I am not critical of Judge Gardner, unlike the JAC she reviewed the bills and made a decision. The JAC attorney agreed to the whole bill.
I remember the whole charade with Kevin Kulik and Backman and BACDL... Broward Lawyers should be ashamed of themselves for not having the intestinal fortitude to stand for something besides greed. Miami defense lawyers stand up for defendants' rights while BACDL cowers in the corner begging for scraps and supports Satz and any judge that will smile at them. If BACDL had brains/guts they would realize lawyers make big city money by looking like champs who get immediate results in court instead of chumps whining and making excuses while they stretch out cases to collect fees before the client goes away.
It is always so funny when someone who posts anonymously questions the intestinal fortitude of others. Maybe evenflo you should show some intestinal fortitude and write your name on your post.
It's easy to see what you are up to Mike. Stay on the issues. You occasionally come up with something good. This is a blog. That means people can post anonymously. It is supposed to encourage different points of view. It's not so you can play the part of the tattletail to get attention.
You hit the nail on the head. Why is it so hard for these wimps to stand up for what's right by everyone, themselves included? Quit the whining and get with it.
I love this blog and the comments are the best, more amusing than the front page. More comments! I hear the judges are all upset. I hear they are grasping at straws. Boy, everything they do brings more attention to the blog. I hope the closets from the last 30 years finally get opened up due to free and open communication in cyberspace.
Nobody would ever think you would be critical of a judge, Mike. That would mean you have intestinal fortitude. Especially if they were wrong. We have good judges and bad ones, no different than anywhere else. Well, maybe a little different in view of more recent events.

There seem to be a few people with their heads stuck in the sand. When is this County going to enter the 21st Century? So much could be done to improve the situation if a few just had the will to do so. In stead they dig their heels in because they think someone is trying to take something away from them. We need a new mind set to improve our legal community. Especially the BACDL. They could have done so much, but I'm begining to think that they are a big part of what is wrong here. What we need is leadership. Is there no one in the BACDL that will stand up to what is coming?
The answer has always been and remains, the BACDL is asleep at the wheel.
I was told the BACDL was told two days ago that they had forty-eight hours to make their argument to the Capital to help save the criminal defense bar from the coming hammer blow. Apparently no contact or effort has been made to soften the impact of todays' decision regarding SPD appointments. I ask "Where is the leadership when it's needed?"
What leadership? There's never been any leadership. It's just a mutual adoration society of four or five people grasping on untill there's no fruit left on the tree.
I guess the guy is as dumb as his picture looks. And before Gardiner of all judges.
The dumb guy in the photo, Barry Butin, has won more jury trials and is a far more successful attorney then you will ever be. Then again, since you cant even put your name on your post we will never know if you even are an attorney.
