I was pretty upset to read Judge Lynch's comments in the Sentinel this morning. Judge Lynch is the Administrative Civil Judge, Dale's right hand man, and the guy a lot of smart people think has been running the Courthouse behind the scenes for a very long time. He says today he wants to be the new Chief Judge, which, if it happens, would mean more Spechler, Dale Ross in a criminal division (Lynch said Ross now "wants to go to trial more than he goes to meetings"), and more good 'ole boy Broward.
Call me naive, call me a fool, call me stupid. I guess all the naysayers were right. No matter what changes we as a community can cry out for and achieve, everything ultimately stays the same.
Why can't we amend the local rules for term limits on the Chief Judgeship? Why can't we rotate the judges every 2-3 years to avoid burn-out/cynicism/racist statements? Why can't we appoint magistrates who reflect the makeup of our minority/majority community, and have a Chief Judge who will influence the JNC to do the same? Why can't we have a full time magistrates judge, and judges who share dockets/workloads, in order to end the backlog of cases? Why can't we have a real diversity committee, with members of the community included? Why can't we end the "in your face" nepotism/cronyism? Why can't we bring Broward's unconscionable incarceration rates in line with Palm Beach and Miami?
Ross said he is stepping down "primarily because of my love for our circuit." Well, if that's true, Ross and company should step aside gracefully. Instead, we get this Lynch garbage, which I believe represents nothing more than the Ross network continuing to pull all the strings.
Everyone knows we need a reform minded, younger Chief Judge, someone independent and untouched by the years of cronyism and political hijinks that have sunk this Circuit to its current depths. And what will we likely get because our judges are like lazy scared sheep with misguided loyalties? MORE OF THE SAME.

It's the same buddy system trying to reassert itself. Are there no men or women of honor who will step up and be counted for what could be a brilliant and sweeping reform of the dirty judicial politics here in Broward? Where are all the good people in this?
Wasn't Lynch part of the secret docket scam concerning his divorce? This is the same old bunch of cronies coming into play here. This place needs a fire hose to be taken to it.

For all you have written about this topic in the last 24 hours it seems interesting that you have not said who you would like to see get it. Enough of this younger, new vision, description, its obvious you have someone in mind so tell us. Dont you think if you got behind someone with the power of the blog in the media right now that that judge may get a leg up?

Does the Chief Judge have the power to assign judges to major civil litigation? Does major civil litigation get transferred out to the satellites with certain judges who may traditionally side with certain business interests? Does LYNCH have to become Chief Judge to protect big time $$$$ interests?
Who Controls the JNC? Who owns the land? Who will control the construction of the new Courthouse from contracts to bricks?
FOLLOW THE MONEY
The raging pit bulls ripping reputations on this blog do little to bring constructive ideas or criticism that would help improve judicial administration. These attacks are purely vindictive personal assaults with no other analysis or coherent suggestions. Rabid comments do little to contribute to the requisite discourse necessary to improve the perceived deficiencies. Instead of trying to bring people down, why not make constructive suggestions, meet with any judge you wish to approach, or try to bring valid suggestions to the bench. Good ideas deserve consideration. You may have proposals which deserve serious consideration. You may also learn something about what life is like on the other side of the bench and appreciate the problems that judges may face. Attorneys have a responsibility to contribute to the public's confidence in the court system - not focus on its destruction. There are excellent judges on the bench who are suffering from the constant belittling. Public confidence in the bench is being eroded. That serves no one. Give the new leader a chance to correct problems - don't go on a path to destroy that person's character or reputation before he or she gets a chance to prove themselves.

I could not agree more with the post above - 8:56. I will be the first to admit that it is quite apparent Judge Ross resigned at this point in his longstanding career as a direct result of the intense pressure and attention that has recently been focused upon his office and operation (much, in part due to Jaab and Bill Gelin's calls Judge Ross to resign).
If true, was this not the intent of Jaab and Gelin all along?
Anyone who has followed this Blogg with any consistency has heard the weekly (if not daily) calls by Bill Gelin for Ross's resignation - ad nauseam.
So, it finally happened. Ross has resigned. What now? What's the follow-up plan? And, personally, I do not consider condemnations of Lynch, other members of the judiciary or suggestions for lawyers to simply "run, run, run", to be any serious strategy. So, what next? Is there a plan? Did anyone from Jaab ever put any thought into the constant calls for Ross's resignation through to their logical conclusion - Actual resignation? If the answer is "no". Well then...yes, Bill - unfortunately, we should all call you "Naive, A fool, and Stupid". Sad really. Nothing is more tragic then a missed opportunity. A rare opportunity emerged for Jaab and it's leaders to be magnanimous, take credit for their work and lead "The Circus" out from under the tent. Instead, (as Gelin has pointed out so emphatically, concerning Lynch's intentions to seek the Chief Judge position) - It's going to be more of the same in Broward County from Jaab and Gelin. More mud raking, no solutions.

You are clearly making statements regarding something you know nothing about. First, you have no grammar skills and Judge Lynch is a fair and impartial Judge. Bonnie happens to be one of the nicest Judicial Assistants in the County and an asset to the division.

How do you show your face before these judges in court that you publicly malign on a daily basis? I take great offense to all the harsh words you have written about these judges. Is it right or just to throw all the judges under the bus because of few. I have been in the system for 20 years and have come across a lot of respectful, nice and honest judges and it really bothers me to read all the harsh words you write about them. Is the judiciary perfect? No, but what is? Are you perfect Mr. Gelin? Because you know people in glass houses. Seems like you have been acting as judge, jury and executioner. For someone that sits so high on their horse, you forgot to list some judges and when they are up for re-election. I totally agree with the comments of 10:27 and 10:33. This blog is nothing but a place for bitter attorneys to come to and vent, it solves nothing and offers no solutions!!!

Afred Horowitz is the only guy for the job. Smart, compassionate, former civil attorney, ran two great criminal (County & Circuit) divisions.
Ross, Lynch, and company made sure the wealthy civil lawyers' cases were farmed out to special/retired judges who would rule in their favor.

Ther was a meeting at shelly Schlesinger's office which included Herb Cohen, Shelly, Scott Rothstein (Republican Labor Lawyer), Bill Schearer and others where they discussed the judiciary. Well, that is like letting the fox guard the henhouse. Theses are the same guys making tons of money off the Ross/Lynch/Spechler triad. No thanks.

What judge lovingly took on her husband's name, not to be placed 1st on the ballot, but out of her deep love for him, only to one month after the election file for divorce, in conjunction with the filing for divorce by the judge who appears in a framed photo, taken while they were on a cruise, and which photo is displayed prominently in her judicial chambers?
A prediction, the next thing would be that Spechler steps down to put some space between him and Lynch. Cowart then gets the nod as his replacement.

Not sure that the retired judges have any impact on these cases. Some of these plaintiff whales often get zeroed out in ETU because the juries hate medmal cases (or possibly listening to 20 out of state expert witnesses). Lynch is a good judge. So is Horowitz.
The good people are busy working. Most of the judges ARE good people who are doing their jobs, working long hours and following the law.

As I have written before, I would agree with your statement. Its very important to support all the Judges who are doing their jobs and following the law, whether they work long hours or not.
The civil division is full of the trash J Ross threw away.The extensive trial division lets the other Judges off the hook and they are NOT moving the cases.Goldstein is a MORON followed closely by many others.Move them back to Criminal they will stop the flow of prisioners and will destroy the criminal docket ..Goldstein forChief Judge Get him off the civil bench now.
Goldstein cant be moved back to criminal court
All Broward Judges should be rotated every two years following the example of other jurisdictions. That will put the breaks on crying judges, old burnouts and remind these people that it's the public they serve!

As the former Court Deputy for Judge Lynch (for eight years),I have observed only the finest example of what a Circuit Court Judge should be. I began with him in Family Court, was with him through Misdemeanor-Domestic Violence and Civil Circuit. For the last few years, Judge Lynch has been the Administrative Judge of Circuit Civil.
One of the first things that Judge Lynch created as the Administrative Judge was the Extended Trial Unit. This Unit was designed to assume the responsibilities for long-term trials that were once heard by retired judges. For legal and economic reasons, these retired judges were no longer able to hear these trials, which often lasted 4-6 months.
Through this entire journey through various Divisions, I have only witnessed the finest of standards of ethics, of knowledge of the law and of cordiality to both sides of any case. I have often heard only great respect for Judge Lynch from the trial lawyers who have practiced in front of him.
It is with great pride that I can say that I was assigned to one of the finest persons that I have known. I think that this is reflected by the fact that he is consistently voted near the top of the most respected judges in Broward County by the local Bar Association, which represents both Plaintiff and Defense Attorneys.
I am proud to call him "friend" and I would like to think that he feels the same.

Hi Jerry, great to hear from you again. It's nice to hear someone say some nice words for once on this page. I just can't believe what a terrible view and lack of respect these young, wet behind the ear, attorneys have for our judiciary. Sounds to me as if they have chosen the wrong career because all they do is bit-- and complain about the system. I agree with your words regarding Judge Lynch, he is one of the good ones.
I am a taxpayer (not an attorney) and I'm disgusted with the judges. I will never vote for a sitting judge again. They are judging other peoples actions and yes they need to be held to a higher standard! Or should I say at least a standard of morality!
You really don't know what you are talking about, do you? I too am a tax payer (not an attorney) but I do work in the court system and have seen both good and bad. Do you have any idea how many judges sit on the bench in the 17th Judicial Circuit? For you to make a random statement not to vote for a sitting judge ever again just because of a few that made the news is just ignorant. Like I said before there are many judges out there that work a full day and are very fair, know the law and live an honest life. It is not right for you to sit there and judge them all because of what you see in the media. Just a little bit of advice, next election, check the credentials and the experience of the sitting judge before you make a hasty decision like that and vote for the unknown. Either way they will still be "judging other people's actions" that's their job! duh.... and a lot of the sitting judges have earned that seat and deserve to be in it. Don't make the good ones pay for the mistakes of others.

The problem goes much deeper than the above writer realizes. These judges are public servants, nothing more, nothing less. The responsibility assigned to them requires them to act in a manner that is above reproach. That is not what we've had in this circuit. We have had a small group of judges that have completely forgotten what it is that they are supposed to represent. The lack of respect they have shown for the citizens of this county is reprehensible. These judges deserve to have the truth be know so that voters of this county can make a educated selection when they decide who stays and who goes. This is not about keeping bad judges in office. The media have done a masterful job of bringing to the attention of the public the antics of these people. It would be one thing if they weren't affecting peoples lives and being paid by taxpayer's funds. Their bad decisions have destroyed people and their families, and then they have the audacity to add arrogance to their actions by insulting and demeaning both lawyers and the people that appear before them. These are not the actions of people that are entrusted with this kind of responsibility. The actions we have witnessed over the years denote a fundamental lack of concern for our society and a complete loss of dignity that should go hand in hand with the job of judge. They have made a mockery of our public trust and have consistently used their office for personal gain and self advancement for both themselves and other members of their family. We know who they are. We all know we have fine judges as well. They know who they are too. We see examples of their good work every day. Unfortunately their good work has been overshadowed by the few in power that have repeatedly shown us that as taxpayers and voters we must be ever vigilant to the excesses of judicial power and self indulging behavior that have been evidenced in this circuit no matter what kind of spin they care to put on it. This voter is going to pay much closer attention from now on to these public servants and register my disapproval of this kind of behavior at the polling place! All used to fear the power that was Rome. Now they will fear the retribution of the voter and the transparency that disclosure of their actions will bring.
It is true that some judges ought to be removed. But there are MANY Judges in Broward - and I'm sure even Mr. Gellin would agree - that should continue on the bench. What we need to do is educate the public regarding which Judges should be removed and have ATTORNEYS that will RUN against them!!!

And what about Rule 4-8.4 (d) engage in conduct that is prejudicial to the administration of justice like deliberately deelaying postconviction motions; (f) knowingly assist a judge or judicial officer in conduct that is a violation of applicable rules of judicial conduct or other law like Raft assisting judge Gardiner to violate the Rule 3.850 and protecting and defending it to the 4th DCA and obst5ruct the state's lawful appellate processes from going forward in violation of Rule of Jud Admin 2.050(f) and Ross violating Rule of Jud. Admin. 2.050(g) by refusing to hold Gardiner accountable to the law and thereby assisting her and ASA RAft in further sabotaging and undermining lawful appellate processes from moving forward also therby violating 4-8.4(a) by knowingly assisting Gardiner and officer of the court Raft to do so.
So whio holds these judges accountable especially when the 4th DCA on mandamus and the JQC upon complaint, burries and dismisses these fundamental Conduct violations and refused to investigate. How come lawyers don't like it when they are called to account for violating their own rules except when it arbitrarily suits them to attack those who blow the whistle, like they are doing to St. Lucie Co judge Cliff Barnes for speaking out about corruption in the courts? And don't the Canons make it an offense to do anything that destroys or undermines confidence in the judiciary to do its lawful and impartial duty? Maybe it's about time you lawyers and whoever is an honest judge pushes for accountability instead of talking out of both sides of your mouths.
