One thing that we all could agree on! ( Clerks Office)




   We all have experienced the Clerk's Office in action; lost files, paperwork that never makes the file, and countless other errors. This Blog contains a lot of information on Judges and how things run. Judges, Lawyers and the Public can all agree that the Clerk's Office needs some fixing.  

   Please comment on the situation, so whoever becomes the next Chief Judge can start fixing the problem.

    Like anything can be done to fix the problems in that office. It's worse than it ever was under Lockwood, and all our Clerk does is wander the halls looking for people that he can talk to. It's a total mess. You'd have to completely revamp the office.

    Recently had a defendant with a traffic infraction received in August 2006. Received first court notice for him in late May setting a pretrial last week. My initial pleadings were filed in Sept,2006 (I have a date stamped copy). Much to my surprise, the file reflected a D6 and late fees even though no court date was ever previously set. When i moved to dismiss the tickets for speedy, the clerk in room 380 along with the magistrate gave me an attitude,and then reluctantly granted my motion. When I inquired about lifting the D6, waiving the wrongfully imposed late fees and issuing an order that reflected that the drivers license was suspended in error, the magistrate gave me an attitude, told me he didn't have time then to do so and to wait till the end of the docket. Needless to say, I told him what I thought about that and proceeded to the clerk's office. After about 30 minutes, the problems were resolved. While the clerk's office screwed this up royally, the supervisor I dealt with was very accomodating in resolving their mistake. I wish I could say the same thing for the magistrate.

    Keith - If you expect any improvement in the attitude of the magistrate, you need to tell everyone his or her name. If they know they will get exposed on this blog, maybe next time they will not cop an attitude.

The more attention that is brought to the specific people that are part of the problems, the better chance we have of providing answers to many of the problems plaguing our judiciary and clerks office. These are public servants. If they don't take pride in performing their duties, make them do their jobs at least.

    Question, why does every other clerk office provide public internet access to court dockets, yet Broward requires you to pay for a "premium access" case search? Why does the public have to pay for information every other circuit provides for free? Where does this money go? Anyone? Second, why is every employee at the clerk's office in need of an enema?

The judges are only interested in keeping the status quo; their jobs, their work assignments, some closer to where they live than others, their workloads to a minimum, career advancement, their salaries and benefits, and their own personal agendas they don't want anybody else to now about. That will mean they will oppose anything that they view as a threat to these things. That is why they don't want change and that is why they will probably vote for Lynch as the new Chief Judge. He represents no change from Dale and what we've had all these years. I'd be surprised if anything else happened in that regard. It's all related to self interest. What they don't get is that change is coming anyway no matter what is thrown in its path in order to slow it down. And the judges that are enlightened enough to know this are feared and kept from making a difference in what we've seen this last year by the ones that continue to pursue their political careers to the detriment of the judiciary as a whole. It's a very simple equation really. Sad, but simple.

Four judges I know of have been involved in covering up a criminal conspiracy, two of these four judges have already been admonished for other incidents this past year. It is also time that the media start paying some attention to the absolute corruption in family court and the court appointed paid GALs, as well as the court appointed Psychologist, and lawyers, boy are they all in bed with each other. There is a case coming up in family court next week in which not only does the spouse have an attorney, but Vicky Plant who is an attorney GAl also has an attorney, and the court psychologist is bringing their attorney. Just who is footing this bill? I bet my bottom dollar that the parent who has the lawyer who has a lot of money already has the judge, Vicky and the court appointed psychologist in their pocket.The GAL and the psychologist often work as a tag team to gang up against one parent to do their dirty work and double bill. What scum. It is about time that Governor Crist call an investigation into Broward court.

    A judge should always be courteous and patient, but even when they aren't, anyone who has graduated from law school knows that a lawyer should always be respectful of the court. On those extremely rare occasions where it is necessary to disagree with the judge, such as in order to protect one's client's rights, it should be done as politely and respectfully as possible. It sounds as if the magistrate did not handle this well, but Mr. Seltzer writing that "needless to say, I told him what I thought about that" is far worse. It should be "needless to say, I kept my opinion to myself."
