BSO guards CJ election 7/3/07
TOBIN v. LYNCH RUNOFF - TUESDAY, JULY 17, 8:30 a.m.
Congratulations to Paul Backman for having the courage to run.
-----------------------------------------------------------------------------
Memo From Chris Stotz/17th Circuit Public Information Officer:
"In an orderly and credible special election for chief judge of the 17th Judicial Circuit of Florida, monitored by all three chief judge candidates as well as Judge Peter Weinstein, a majority was not reached. Today's results are below. A run-off election will take place between Judge Thomas M. Lynch, IV and Judge Victor Tobin on July 17, 2007 at 8:30 am, with the same election procedures as today.
ELECTION RESULTS - July 3, 2007
JUDGE # of VOTES
Judge Backman 22
Judge Lynch 33
Judge Tobin 30
Judge S. Kaplan 1 (write in)"
--------------------------------------------------------------------------------
(Thanks to Fred Goldstein. From the wording of the memo, it would seem his letter had a strong impact. There were 63 judges present, 23 absentee votes, and 2 no votes. Wouldn't it be cool if Michael was the write-in for his Dad?)

I hear the votes were 32 votes for Judge Lynch, 30 votes for Judge Tobin and 22 votes for Judge Backman
Wrong on the votes for Backman. No such numbers.
Doesn't Chief Judge Lewis choose now?
Guess to whom Backman's vote go?
sounds like the clan is trying to just bring in another hooded judge
If the judges have the conscience to do what's right, they'll go to Tobin for a fresh start. No political baggage and the right man for the job!
How can Bacman sit on the JQC that just decided no PC on Greene? Wouldn't he have to recuse himself? Is the dirt of this circuit staining the findings of the JQC as well? How can Backman do this and run for chief judge (Even though he lost again) at the same time? Man, this town is something!!! Sounds highly questionable. Who is charged with overseeing the JQC ?
How do you like them apples Cyberblob?
TOBIN IS A GOOD MAN AND ALWAYS HAS BEEN
One step closer to a cleaner judiciary
YOU GOT THAT RIGHT!!!
Once Tobin gets in there, things will be cleaned up because he has the guts to say what is right and do what is right. Without him speaking out I wonder whether there would even be an election, probably just Ross handing the baton to his right hand man (judge).

VOTE EARLY
by Rumpole
It's election day for a new chief judge North of the Border.
We shall endeavor to sift fact from fiction, truth from rumor, all the while remembering that this is Broward, so anything can and probably will happen.
Rumour: The Florida Supreme Court has appointed Jimmy Carter as election monitor.
Rumpole says: NOT TRUE. A spokesman for the former President said that because there was not any affordable parking near the courthouse, the former President would regrettably be unable to attend.
Rumour: Each judge will enter a Survivor type voting area where they will hold up their choice and explain their vote for the TV camera.
Rumpole says: POSSIBLE. Judge Ross has declared the courtroom where the votes will take place off limits to the public. "Openness has no place in our democracy" Ross was quoted as saying. Since the voting is secret there is no way to know just exactly what those 88 robe wearin, party type people will be doing.
Whatever the result, we will endeavor to report it as quickly and as fairly as possible ( as soon as we regain our composure and stop laughing.)
JUDGE FEDERICO MORENO IS NEW CHIEF JUDGE OF THE SOUTHERN DISTRICT OF FLORIDA.
As surprising as it seems, the Feds were able to appoint a new chief judge for a term specific seven years without any controversy. Judge Moreno, who got his judicial start in our own County Courts of the REGJB, is the new chief of the Federal Judges for the Southern District of Florida. Before that Judge Moreno was in private practice, and before that he was a member of the Federal Public Defenders Office.
Longtime and careful readers of the blog may remember that while in County Court, Judge Moreno was forced to issue a bench warrant for one of the Miami Dolphins who did not appear in court. The warrant was issued with this admonition: "Do not arrest on Sunday." (We vaguely remember the Dolphin in question was one of the wide receivers- Clayton or Duper, if we recall. Any one else remember who it was?)
With this kind of wit and wisdom, we think Judge Moreno will do a fine job and the Southern District of Florida is in good and capable hands. We wish him well.
Golly gee, the Feds have a term limit for chief judge. What do they know that we don't?
I bet Lynch comes out now supporting term limits. I bet he supports everything and anything now that the Ross machine is in jeopardy.
Maybe another haircut is in order. Still a little long in the back Tommy, don't you think?
Broward judges please say no to ROSS LYNCH SPECHLER on July 17!!!!!
who is cyberblob?
Predictions as to who will be the next Chief Judge of the 17th Judicial Circuit creep inexorably closer to what may be what's called for in Broward's Judiciary; A New Beginning and a Severance from what can only be described as the worst display of Outrageous Judicial Behavior in Florida's History.
I'm a bit surprised by the results. I am relieved that Backman got clobbered, he's scarier than Ross (more Machiavellian and maniacal). Tobin did much better than I expected. Could be the dawn of a new era. On the otherhand, Backman could throw his support to the old regime and Lynch is in.
How about just giving our good judges the benefit of the doubt to do what's right, or is that asking too much?
The kind of attitude expressed in this picture is exactly what's wrong with this place. What's with the arm across the door, stupid? These people are really too taken with themselves in this town. This is what Ross encouraged all these years and what has really created the havoc we see now. Really poor form again. Is the gesture captured in this photo supposed to intimidate anyone wishing to be an observer? BAD MESSAGE AGAIN
I guess there are at least 55 people who are no longer DALEFANS
Did Seidlin vote? Since his retirement is moved up, doesn't that cost Lynch a vote on July 17?
I disagree. I think the photo is great. Just a guy doing a good job in a really starnge place.
I wonder if Ross's phone is ringing off the hook right now. I wonder if he's already talked to Scherer today, or if Scherer even cares anymore.
This place needs an enema.
Actually, I went up there. The deputy was very cordial. No problems at all. I was glad to see that the vote was opened up to review.
As for the next vote, I will have to defer to the judges. I believe they want a new fresh beginning as much as everyone else. Along with the potential of the past to be perpetuated, being considered in each of their vote.
Talk about no decorum! I agree with the above post; The guy's posture does nothing to instill any kind of dignity to the proceedings.
voting for lynch doe not sound like they want a fresh start
I hope Lynch doesn't dump Ron or Gardiner as Admin Judges to make room for Backman. I bet there will be some real wheeling and dealing the next few weeks.
Look at it this way: 30 Votes for Definite Change; 22 Votes that also didn't go to Lynch; and then the 33 Votes for More of the Same. How do you think it will come out on the 17th?
You may be right. Lets hope the judges follow their consciences on this path to restore dignity to our judiciary.
Hope that's not asking too much of our judiciary

New Chief Judge
Congrats to Judge Moreno on becoming Chief Judge of the Southern District of Florida. And a big thank you to Judge Zloch for his service over the past 7 years. It's not an easy position and it's mostly thankless. Here's the district's press release about the change. Any thoughts as to how the district will change with the new chief?

You obviously don't practice in Broward. That is one of the best deputies they have here. He is very professional and overall a great guy.
TOBIN REPRESENTS EVERY THING DALE DOESNT....FAIRNESS, ACCOUNTABILITY,INTEGRITY,DEMOCRACY AND DUE PROCESS.IN THE PAST NOT ONE FREAKIN 'JUDGE' (I USE THE TERM LOOSELY)HAS HAD THE BALLS TO DEFY ALMIGHTY DICTATOR DALE AND HE IS TOO MUCH OF A PIG TO STEP ASIDE BEFORE SERVING 3 OR 4 TERMS AS CHIEF DOUCH!! WHILE THEIR AT IT,THE NEW NON-SECULAR,FREELY ELECTED TOBIN ADMINISTRATION NEEDS TO ADDRESS THE ISSUES SURROUNDING THE CIRCUIT CRIMINAL SO CALLED 'BENCH.'STARTING WITH THOSE WHO SEEM INCAPABLE OF RECOGNIZING OUR CONSTITUTION OR ANYTHING THAT REMOTELY RESEMBLES DUE PROCESS. NEEDLESS TO SAY, ILENE O.IS NOT ONLY UNFIT TO SERVE THE BENCH, SHE LACKS THE CHARACTER NECESSARY TO SQUEAL IN PIG SHIT.SHE SHOULD BE INDICTED AND SERVE FSP TIME.LEVENSON, WHO CONTINUES TO PROSECUTE FROM THE BENCH WANTS SO MUCH TO BE LOVED, THAT HE HAS GONE AS FAR AS ACTUALLY GRANTING A DEFENSE MOTION FOR CONTINUANCE ONCE, WHILE APPARENTLY CAUGHT AT A WEEK MOMENT.AND LETS NOT FORGET THAT LOVELY AND SWEET DISPOSITION OF POWELL-ROD!! NOW, I KNOW THEY NEEDED A ALEMAN-LIKE REPLACEMENT BUT I GOTTA HAND IT TO THEM FOR APPROACHING AN ACTUAL CLONING OF 'ONE WHO KNOWS NOT COMPASSION." WHILE WE ARE ON THE SUBJECT OF THE UNFIT, I FIND IT MIND BLOWING HOW SOME OF THESE FIGUREHEADS CAN SIMPLY 'QUALIFY' BY SHAKING MORE HANDS THAN THE OPPOSING CANDIDATE. FAR TOO MANY OF THESE JOKES FOR JUDGES HAVE NEVER TRIED A CRIMINAL CASE, NEVER MIND ATTEMPT TO PRESIDE WITH SOME SEMBLANCE OF TRAINING OR EXPERIENCE.FELONY MURPHY IS A NICE GUY NO DOUBT BUT DOESNT SEEM TO CONCERN HIMSELF WITH THE MOST FLAGRANT VIOLATIONS OF BOTH HUMAN AND CONSTITUTION RIGHTS THAT WOULD EVEN REPULSE THE LIKES OF SOME BUSH ADMINISTRATION OFFICIALS!! BERMAN, WHO HAS AT TIMES TRIED CIRCUIT CRIMINAL CASES ONCE SO INTELLIGENTLY RULED THAT EVIDENCE OF A CIVIL SUIT FILED BY AN AGG ASSAULT FIREARM VICTIM AGAINST THE ACCUSED IS INADMISSABLE TO SHOW BIAS OR ANY OTHER OBVIOUS TRAITS THAT ANY THIRD GRADER WOULD RECOGNIZE AS PROBATIVE AND RELEVANT.ONE BRIEF REFERENCE TO COWART, WHOSE SHOULD BE AWARDED FOR HIS TEMPERMENT, ON THE OTHER HAND, WEARS HIS NAME WELL. THIS GUY LACKS THE FORTITUDE OR PENILE SUSTENANCE TO GRANT ANY DEFENSE MOTION THAT MIGHT REMOTELY RESEMBLE SUBSTANCE OUT OF UTTER FEAR THAT SATZ MIGHT BLOW A GASKET AND REDUCE HIM TO A SWEET, EASY-GOING 'NICE GUY'AND HAVE HIM REMOVED FROM THE COMFORT OF THE PERCH HIS WIDE ASS RESTS UPON SO FITTINGLY.LEAVE LENNY ALONE...HE BASICALLY IS A FAIR-MIND,RELATIVELY STABLE AND NICE GUY WHO ,UNLIKE SO MANY OF HIS COLLEAGUES,TRIES OFTEN TO DO THE RIGHT THING.ZACK IS BELOVED BY EVERY DEFENSE LAWYER EXCLUDING CHRIS ROBERTS BUT I CANT IGNORE HIS BLANTANT DISTAIN FOR THE STATE THAT EVEN I GUY LIKE MYSELF,HAVING NEVER SERVED THE STATE AND BEEN BORN TO LITIGATE FOR THE ACCUSED, SHUTTERS AT. LETS JUST HOPE AND EXPECT TOBIN CLEANS UP THE GRAFT, CORRUPTION AND CRONYISM SO OFTEN TOLERATED BY DALE AND THE HOMIES.
