Look to the statute--it is not one of the what the legislature called "enumerated crimes" which they, who know the meaning of words, assigned letter designations as "enumerations," that require the imposition of the min-man for "possession of a firearm during the commission of" under 775.087(2) "regardless if it was an essential element of their felonies" or not.
However, as I believe, because he is a police officer, his betrayal of the public trust and violation of his aoth should be an automatic treble "aggravating sentencing factor" to put thispiece of crap cop away forever.

I can't believe my ears. Why would these cops get such a light sentence when citizens, and particularly black citizens would go down big time? What's with the double standard in Broward? This is an outrage to Justice.

Mr. Satz now wants to investigate this matter and to have an independent expert examine the false videos produced by Hollywood to charge and convict this defendant. This, after Mr. Satz informed the FBI several years ago that he was investigating Hollywood's submission of false and altered evidence in this case. Truthfully, Mr. Satz is looking to prolong the defendant's imprisonment; he has had four years to investigate, and he well knew of the false and altered evidence submitted to his office for purposes of prosecution. He did nothing about it and maliciously proceeded to prosecute this Defendant and put him in prison for 5 years. The Defendant has served 4 years and is back before (rubber stamp Gates) under Criminal Procedure Rule 3.850, and Mr. Finkelstein's Office, as it should, has stated that it will appear before Judge Gates and admit that the defendant did not receive effective assistance of counsel. Judge Gates is contemplating giving the State Attorney a continuance to investigate. Indeed, that would be a matter to be resolved in a new trial, not in a 3.850 proceeding. At this point, whether the evidence was false, or not, defense counsel failed to investigate, even though Miss Torres and Larry Schweiker knew all along that the evidence had been altered. In fact, they made comments to Channel 7, the Herald and other news agencies that they knew that the evidence was falsified. Yet, not, they allege that they did not have a clue that the evidence had been altered.
Let's see how Judge Gates rules on this: will he grant a continuance to Mr. Satz to RE-investigate, or will he follow the law and constitutional precedents and set the conviction and sentence aside. Defendant has mooted any excuse Gates has to grant a continuance by removing the issue of the intentional use of false and altered evidence off the table, and to include the issuea, only, as an element of ineffectiveness of counsel. Next hearing will be tomorrow morning at 8:30 a.m. (Tuesday, 8-28-07)

It was found that the State Attorney's desire to investigate was nothing but a delaying tactic. They had investigated the false evidence 3 years ago, and their video expert skipped town and refused to testify. Baker was freed, but he had to renounce the truth in order to obtain his just freedom. THAT SUCKS.
