As an aside, I heard that Bill Scherer paid Howard a visit today.  If I'm correct, that means Skip Campbell, Jeff Fenster, and Scherer have all recently sat with the Public Defender.  I don't know what they talked about, but it seems that the recent publicity surrounding the push to help the judges "become functional again" (Skip Campbell), is much more than lipservice this time around.

Hey guys, how about addressing the fact that Broward continues to send non-violent offenders to prison at rates that dwarf our neighbors Miami-Dade and Palm Beach Counties?  That our shortsighted policies multiply exponentially the social and economic costs, all paid by honest taxpaying citizens?  That violent crime rates continue to rise with no end in sight, primarily because we squander our precious resources?

    It's no wonder the politicos are trying to better the tarnished image of some of our esteemed judges. If the judges in question can't or won't do anything about solving the problems that are evident on the bench themselves, it's predictable that they would ask the political machine to step in to save what has become the most ridiculed judiciary in the state. That way the judges will be beholding to them and ripe to return the favor in the future. That's politics in Broward. The only thing that continues to suffer is justice.

    TALLAHASSEE -- (AP) -- Blood-alcohol breath-test results were thrown out in four DUI cases after a Leon County judge ruled Tuesday that results can vary depending on how long someone breathes into the device.

    Attorney Lee Meadows, who is representing the four men arrested in 2006, said the ruling could have a big impact on others facing DUI charges.

    ''At this point, it will potentially stop the prosecution of every DUI case in Leon County that has a breath-test result,'' Meadows told the Tallahassee Democrat.

    State Attorney Willie Meggs told the newspaper that the ruling likely will be appealed.

    ''We've got the newest and best technology out there to determine a person's blood-alcohol content,'' Meggs said. ``It's been approved by FDLE and used all over the country.''

    Aiken's decision regarding the Intoxilyzer 8000 is similar to a Bay County circuit-court ruling, which said, ``Rules that permit a test operator to have the subject blow into the machine as long as he, in his undirected discretion wishes . . . is insufficient to create a scientifically reliable test.''

    Meadows said he planned to file motions seeking to adopt the ruling for 30 to 35 other clients he's representing.
