Next stop case filing --- why didn't they send someone like Gallagher in there to smooth it over?

These murder cases keep going out the door. Dissmissed, Time served, Concessions for New Trials, the Fourth and the Supreme Court.
Time to revamp Satzie.
Your elitist BS units don't work. Try training some junior and mid levels to do the real work instead of forcing them to mop up residue and other garbage until they quit.
The others are so busy clearing dirty cops and politicians and sending pill heads to prison that the violent psychos walk with alarming frequency.
Time to clean up the mess or pack your bags because at this rate you're going to look a major fool in 2012.

"Stone, however, did not go free. He remains in the Broward Main Jail while appealing a life sentence for violating probation on a 2003 armed robbery conviction."
The scumbag isn't going anywhere anyway.
The arrogance of this is stunning however.
More tax dollars out the window.

How else can this blog spin this story?
Rossman said he had been assured by a court clerk Jan. 27 that he would have the evidence for trial.
"Obviously there was a breakdown in communication," Clerk of Courts Howard Forman said. "Right now that's all I really feel comfortable telling you. We're not sure how it happened. We're trying to gather all the information to figure it out."
---------------------------------
Seems very simple to me.
State ready for trial.
Jury sworn.
Witnesses waiting outside the courtroom.
The Clerks office FAILED to have the evidence available.
The ASA attempted to remedy the problem.
"All I wanted was until [Wednesday]," Rossman said. "Without objection from the defense, I asked for that 24 hours and that was denied."
The court abused its discretion.

Ever heard of Abuse of discretion, Suzie Q?
Ever since Lebow started bringing her dog to the courtroom, things have been getting harry for Lebow.
Maybe just a little evidence of Lebow nearing the edge of retirement, or insanity. And not a moment too soon for many.
Susan has been swinging out on a limb for a while, some say with fairly deleterious effects to the position she's held for, again, maybe just a little too long.
Getting long in the tooth, you gotta know when to get off the bench before you start appearing like some parity of yourself, Susan. That time has been and already gone.
Time to consider taking your dog for long walks in the park instead of bringing it to work with you as a security blanket.
And I don't know what you're on, but lay off the coffee.
It doesn't mix well with whatever else you're on.

dumb move lebow in a year you are up for election. Besides gelin the voters in this town don't like judges that let murderers go. Your stupid rulings are finally going to catch up with you and the voters will now have their say. It's gonna be lets go home lebow.

If you're bring a man to trial for his life, isn't it a good idea to have evidence? I agree with the ruling

Its no accident that Rossman caused this situation. He has been a problem for a long time. Satz should fire him immediately.

Go Suzie! Show them judges run the courts, not prosecutors.

The State got caught in one of their favorite lies; We are ready for trial. They did not have the evidence in their posession. A jury was picked and the State told to proceed. Did the only witnesses the state have need the evidence or did they not have any witnesses under subponea. It appears the State go caught in the BIG LIE!

Lebow acted arbitrary and capricious

No one will run against Lebow. And Mr. Satz is too much of a wimp to let any of his people do it. She called them out on their usual garbage knowing she's covered with the VOP life sentence. I say good for her. The state is always playing games and she called them out on it.

To 9:56 and 10:20
it's obvious you don't know the facts. The clerk of courts had the evidence because the vop is up on appeal you uninformed idiots! Now the clerk states the evidence never got there but would get there the next day and the judge couldn't wait a couple of hours? The families of the victims deserved more than that, the citizens of broward deserve more than that. What she did is an abuse of discretion and just disgusting. I will vote and give money to anyone that runs against her.

The SAO should stop looking to get rid of Lebow and figure out how to get rid of Satz.

The Florida Constituion affords victims the right to be heard. Lebow did not care. I hear Seidman may run against Lebow.

Gregg Rossman is one of the most honorable and courageous people I know who always strives to do the right thing, unlike the many folks who post anonymous comments on this website but aren't brave enough to put their name behind their scathing, and often ignorant, opinions. As far as this homicide case is concerned, perhaps someone could explain why the defense has been granted several continuances, but yet the state is not allowed one for a circumstance beyond our control?

Seidman is going to run against Lebow (@12:29)?
Which one? Laura, little Lee Jay (how does he get to do political events in the middle of the day without taking a formal vacation day or time --- aren't there supposed to be hearings or something), or is there a third Seidman family member waiting in the wings?

Rossman death penalty all the time seeker. He must get a woody from it.

What is obvious is when a post comes from a prosecutor. But it would have been better to hold the prosecutor in contempt of court for his refusal.
Reply to this
So what? It still doesn't change the fact that you are totally ignorant about the facts in this case yet you continue to open your mouth anyway. It's obvious you are an ignorant defense attorney and I feel bad for your clients.

I wonder which prosecutor leaked the story to the SS?

The judge issued an order to an attorney, who refused to comply. Not too smart. He certainly did not need "evidence/exhibits" for opening statement. In fact, he is not allowed to use "evidence/exhibits" in opening statement. Prosecutor could easily have gotten "evidence/exhibits" within 2 hours from WPB. Not too hard to drag out opening statement and first witness' direct exam until exhibits arrived. State might owe victim's family an apology.
Reply to this
No! Susan Lebow owes the victim's family an apology.

good point! when an attorney tells a judge that he is ready for trial even though he doesn't have his evidence, that obviously is the judge's fault. when an attorney refuses to comply with an order of the court that is also the judge's fault.
Reply to this
Can't wait to see what bigger surprises can happen in that race?
Does the spectre of the "Jewish female" turn into reality?
Does Lee retire and/or run for another seat (as there have been posts about)?
Does Lee have his minions kidnap the challengers and bring them to his secret Parkland bomb shelter or North Carolina mountain retreat for a "stern talking to"? (just kidding)
Does Seidman drop out, reveal that he is actually part Cuban and run for president of CABA?
WHEN DO WE GET THE NEXT SURPRISE!!!

What bothers me is that when it is a defense attorney having an issue with a judge, the caption is always "You Make the Call." Here it is already adjudging Mr. Rossman in the wrong. Why couldn't Mr. Rossman make an openning statement? How about because after requesting the evidence, being told that it was here, to only find out it wasn't he could not ethically tell a jury what he believes the evidence will show, because he had no evidence to show them! Finally, how can a judge tell a prosecutor to go forward with a case, when a bunch of judges up north have the evidence the prosecutor needs in order to go forward. What is not being reported is the assurances Rossman got from the Clerk's office that the evidence would be here for the trial only to be told that it didn't make it down. Finally, everyone is going to be real surprised when Judge Lebow is reversed on this one. If 99.9% of the time a JOA is unappealable, ladies and gentlemen, here is that .1%.

Thanks Gregg or Gregg's secretary, 2nd chair, or other SAO anonymous spokesperson........
I'll wait to read the transcript and make my own opinion rather than listen to your spin (or the blog's).
I am sure Bill will post the transcript once it is ordered.

Please wait and read the trancript and don't make idiotic post like some on here have without being informed of the facts. Judge Lebow was 100% wrong.

not to mention that she gave the defense a 2.5 day continuance to get something done, but couldn't extend the same courtesy to the State?

She is just being Paris Hilton cool. Craving attention and asserting her "power" in a passive/agreesive manner - who else could get into the courthouse with a dog (except cops, but that actually makes me feel more secure)

I know personally that Gardiner did not come in to work one time last week. All of the other Civil 10th Floor Judges covered for her and they are getting sick of it.
