Thank you for finally numbering and labelling the administrative orders in a coherent fashion. I never knew anyone who could ascertain the old jumble system they used before. It almost seemed like the old guard didn't want the public finding these things. Can you imagine that?
I wonder why all the JNC members who sent Stacy Ross up didn't get a day of distinction?
The 17th honoring a man with questionable morals and judgement like Jenne - par for the course!
What if November 1 falls on a weekend? Ken will not be properly honored that day. The order should provide that Jenne Day will be rolled to the next business day.
Judge Tobin - Please correct this oversight immediately and amend this very important order. Ken really needs our support at this time in his life.

Rumpole responds: Assuming for argument that is Mr. George, we respond with this open letter:
Dear Mr. George:
First, welcome to the Miami Criminal Defense Community.
However, unlike other new lawyers, you are not being welcomed with open arms. Why? Because the very existence of your job will deprive many of our colleagues of a living. Some of our colleagues have worked very hard for many years to obtain the skills necessary to represent Defendants in criminal court. Many of these lawyers worked for years at low pay for the State Attorneys Office or the Public Defenders Office and then went into private practice with the skills necessary to represent individuals charged with crimes.
Your job will deprive our colleagues of a job. We recognize that you did not cause this situation. But you are profiting from this situation much like a scab that crosses a picket line in a strike. What makes matters worse is that it appears to many of us that you take this job without the hard earned qualifications and experience in criminal law that almost all of us who work in the REGJB have. When you meet members of the defense bar, you will notice that all of them are justifiably proud of the work they did as prosecutors or public defenders. As far as we know, you did not work in either office. The experience they obtained in those jobs gives them the ability to assume the awesome responsibility to stand in court between the state and the Judge and say "prove it."
So you assume your job with two strikes against you: a perceived lack of experience, and the belief that you and you alone are profiting from the misfortune of hundreds of lawyers. That is quite a load to bear in a new job.
However, beyond the money and the anger, lies the most important reason of all: concern for the client. You will notice that almost every criminal defense attorney has a strong desire to see the system work and see clients well represented. The feeling among the defense bar is that the clients your office represents will not be well served. The belief is that the attorneys that will staff your office will not have "the right stuff" to represent individuals facing the death penalty, or life in prison, or a lengthy minimum mandatory sentence.
Just how many Arthur Hearings, let alone criminal trials, have you done?
The remarkable thing is that many of your new colleagues can speak from experience about the intricacies of a consent defense in a sexual assault case, the difficulties in voire dire in a drug entrapment defense case, while also exhibiting a working knowledge of things like blood spatter and exit and entrance wounds. The problem is that while your colleagues obtained that experience while working on cases with more experienced lawyers, you and your staff will apparently be obtaining that experience on the backs of your clients, and to their detriment. And that bothers us a lot.

The Legislature has no problem spending money on police and prisons, but when they skimp on something as important as the Sixth Amendment right to COMPETENT counsel, we take that pretty seriously.

Ken Jenne plea agreement and information
Here's the plea agreement and the information (courtesy of the Miami Herald).
A couple interesting facts:
1. The case drew Judge William Dimitrouleas, a Clinton (corrected from original post) appointee. Before getting appointed, Judge D (as he is known in this District) was a state public defender (for two years), a state prosecutor (for 12 years), and a state judge (for ten years). In other words, he knows Jenne well. How this will cut is anyone's guess.
2. The plea agreement calls for an advisory guideline range of 18-24 months. Many plea agreements do not set forth how the guidelines are calculated, but this one does in (complicated) detail.
3. Former U.S. Attorney Tom Scott, along with David Bogenschutz, signed the plea agreement as Jenne's lawyers.
4. Both sides reserved the right to argue for sentences different than the guidelines. Sometimes defendants and prosecutors will agree that the guidelines will apply and sometimes the defense reserves the right to argue for a lower sentence. In this case, the defense reserved its right to argue for a lower sentence and the prosecution reserved the right to argue for a higher sentence.

This order was issued early into the Ross chief judge tenure. A nice political gesture.
Offers a glimpse into how to turn a nothing post into a fiefdom, I think.
Ross wants to honor a sheriff that's been indicted? What's this about? Is this Ross as dumb as people have been saying? I'm beginning to think so. Jenne has cost the tax payers of Broward hundreds of thousands of dollars and this turkey wants to have a cook out in his honor? SOMETHING IS VERY WRONG IN THIS COUNTY!!

As I have previously reported, the judicial races "North of the Border" have been non-existent, with none of the judges filing for relection - compared to Dade County, where nearly all of the judges have filed.
Finally, there has been some movement - and - in one case - it is BIG.
In Group 21, long standing jurist Stanton Kaplan, (who has yet to file for re-election) has drawn opposition with the filing by attorney Merrilee Ehrlich. Ms. Ehrlich drew some noted attention last year, when she filed at the last minute to run for the office of Attorney General, filing in the Democratice Primary against Skip Campbell. Campbell won the primary, but lost in the election to current AG Bill McCollum.
The only other judge to file for reelection in Broward is Jeffrey Levenson.

I hate the injustice our justice system that has been shafting us with for over 20 years now.
I hate the fact that Ken Jenne used his political career to obtain and then abuse power at times. I hate the fact that the Feds overlooked how Jenne used his office as an unofficial private investigator for his political buddies and for personal profit. How many citizens were harmed as a result of this?
I hate the fact that a handful of powerful families continue to clutch at the political offices of this County when they are in the minority all for the sake of personal profit.
I hate the fact that guys like Scherer and his cronies, developers and businessmen alike, continue to determine who will serve in the courthouse and in other political offices instead of letting the political process work on its own.
And I hate the fact that those same people still steer cases in the courthouse and trade favors in Tallahassee for courtroom toys and funding.
Imagine that the reason why Satz is prosecuting everyone to the fullest extent of the law (except the powerful and politically connected) is because our state prison system has been privatized. That means rich guys are getting richer and Satz probably owns stock in those companies, or is somehow promised some benefit as a result of his prosecutions.
I hate it that we sentence more non-violent offenders to prison than any other county in the South. How many families have been damaged because of it? How many kids end up dependency referrals because of that? How many marriages are destroyed because of it? How many futures were destroyed?
I hate to say that I am sick of it. I am disgusted. And its time for all of this to stop.
So the answer to your question is that I don't like being the 17th's unofficial historian. Let my words bear witness then.
WILL SOMEONE PLEASE FILE AGAINST ROSS? THIS COUNTY NEEDS DESPERATELY TO CLEAN HOUSE OF THESE PEOPLE! AND HE'S NOT THE ONLY ONE. SO MANY OF THE BROWARD JUDGES NEED TO LEARN ONCE AND FOR ALL THE POSITIONS THEY HOLD ARE NOT FOR EVER. THIS COUNTY REALLY NEEDS A CHANGE. A KEN JENNE DAY? ROSS NEEDS TO HAVE HIS HEAD EXAMINED TO BEGIN WITH.
Ross looks like a real Blowfish in this move. Will this guy do anything to bring attention to himself? YOUR OUT OF THE PICTURE NOW DALE. GET IT? TRY GETTING A LIFE THAT DOESN'T INVOLVE MAKING THE 17TH LOOK LIKE THE BACK END OF A BABOON.
He must have eaten something that didn't agree with him. It may have been blowfish. Who knows? I agree, he needs to get over himself and move on out! Preferably out of Broward. Most certainly out of the courthouse. A really mean, little man that's caused allot of trouble and heartache to many and served to show us what we must never allow to happen again, to allow a tyrant to manipulate our system of justice for his own ends.

I agree. It's a most deplorable situation when human beings wholesale and for the sake of greed and control continue to make headway in their dark little schemes at the expense of others whom are less fortunate. Arrogance, carelessness and corruption are bad combinations. We seem to have it in abundance in Broward. The double standard that is employed in bringing the politicians and judges to justice for their transgressions compared to ordinary citizens can not be defended either. It's a very bad situation that has to continue to have light shed on it in order to combat a relentless enemy that seeks to continually hide in the shadow of complacency.
Tom Scott--Ha, Ha, Ha! There's a joke when he was a US Atty--wouldn't protect the public then--wants to uplift similar actions by other bad public officials by minimizing punishment,now. Left the job for bigger bucks?
Shouldn't the fact that Jenne was a public servant the absolutely betrayed the public trust under color of office be a maximun aggravating sentencing factor--when it becomes that--then things might change--let this be the starting point. 3x sentencing enhancement with a minimum-mandatory 25. That sounds fair. Let the legislature enact that!!
