MIKE MAYO: "PENALTIES IN SIMILAR DUI CASES DIFFER BY MORE THAN A YEAR":

"Our justice system can be curiously inconsistent. Take, for instance, the case of two habitual drunk drivers. One comes from a well-known local family (Huizenga). The other is an obscure 65-year-old man. Both caused injuries after getting behind the wheel intoxicated. Both had multiple prior offenses. Both pleaded no contest to felony DUI.
One is serving 120 days in jail. The other is in state prison for two years."

A good article by Mike Mayo except he misses the issue relating to how these two individuals were charged by the SAO. In the DeAngelo DUI, he was charged with DUI/Property Damage/Injury (06013226CF10A). Of course Huizenga, who hospitalized the old man after nearly killing him, avoided any injury or property damage charges (03020237CF10A). How is this possible? Does it pass the smell test to you? - Bill Gelin

BROWARD JUDGES RISE TO ALEMAN'S DEFENSE:
http://www.miamiherald.com/news/broward/story/318740.html
"When Broward Circuit Judge Cheryl Aleman goes before a judicial oversight agency on charges of being ''arrogant, discourteous and impatient'' to lawyers in her courtroom, about a half-dozen judges will testify as witnesses -- mostly for the defense."
http://www.miamiherald.com/opinion/editorials/story/318464.html

"On Dec. 5, 2003, Huizenga's Range Rover plowed into Feigenbaum as he crossed Las Olas Boulevard. It was a rainy night, and Huizenga was cited for driving without lights and making an improper turn. Feigenbaum spent a night in the hospital with a concussion, a broken elbow and a head gash that required eight staples. He said he still has sporadic dizzy spells."
just like the system they really stick together. o'connor has lied and showed her prejudices of races and diff. ethnic people. hey maybe ross should step forward for her. maybe he hasn't sexually harassed her. we have to figure the guy is guilty of rape when he lets lawyer marilyn lindsey talk about how he raped her over and over again. u would think if there is no truth to it, he would have her in court suing her and her law firm for what she put on the blog. or go to the fl bar and have her license pulled. come on ross show us all those steroids didn't shrink ur testosterone producer. show ur family that ur innocent and fight for ur self or just say ur guilty
Of course all the judges will step forward to testify for Aleman. They're all eating out of the same trough, the public trough that is. This is not without precedent. Every time one of them gets into trouble the wagons circle to protect one of their own without any consideration to conscience. After all, it could be them the next time. This time they just went a little overboard with the clear motive in mind of showing solidarity. It's not as if they don't already have the JQC working for them anyway, ala Judges Backman and Gehl (Who knows how?) It shows the extent of their insecurity. God forbid one of them give up the public trough and have to practice law for a living! Then they couldn't continue to be a big blow fish in this ever expanding pond called Broward County. What a horror that would be! I mean, they've given so much back to the communities they (serve?) after having taken and taken and taken ...
To be arrogant, discourteous, and impatient? Isn't that in the oath the judges swear?
come on judge ross we all know if u are innocent that u would not stand by and let an attorney make statements of multiple rape by u like marilyn lindsey has. at the very least u would report her to the bar. i have seen attorneys have their lcense suspended for less. are u innocent or guilty. let ur family know i'm sure if u are innocent they would expect u to defend urself. or are they supposed to go around thiking daddy is a coward or a rapist
david
do you cut and paste this stuff...cant you at least write it in a different way.. at what point can you understand no one cares about your claims.
obviously u don't care about changing the system, u like the power the way it is so u can abuse others and as u can see u don't bother me with ur chatter. if u don't like it don't read it.

"Now Nicewander and prosecutor Joseph Zager have formed a new unit that will focus solely on cyber-crimes against children. It will be funded by a $180-thousand grant from Children's Services Council of Broward."

Is there anything wrong with a person defending herself. I am sure all of us always represent only innocent persons. Is is wrong to testify truthfully on behalf of a person even if you are a judge? What is wrong with all you hypocrites, who call themselves lawyers, do you only call witnesses who provide adverse testimony for your client? From what I see very few of you call your client to testify in a criminal case, is that because your client is guilty or comes with a bad record? How many of you have called clergy to help your clients case? Is that wrong? Remember who you are? You are litigators not a "potted plant".
when they circle the wagons and many of those who are testifying for her are pigs. if they were not protected many of them would be behind bars. hard to trust any of them when they get away with so much and all anyone says is it's ur perception that they did wrong. bs i've seen to much to believe that but i have been in front of judges that surprised me. i have seen some call balls and strikes and do their home work. far and few between.
I'd have more respect for her if she just took her "licks" from the JQC and called it a day. but to put on this dog and pony show when the record is pretty clear about what she did and what transpired in that courtroom is just pathetic.
WWJD?????
The judges testifying for the defense in Aleman's case are gaming the ol' Prisoner's Dilemma. They know the game and the theory well, having seen it played badly a million times by a million saps tricked by a million cops.
A judge will not break ranks until he is convinced he can grab the cheater's edge--and judges know better than most that when everyone is driving on the shoulder, no one has the advantage.
Judges also know damn well that they have gotten away with far more serious crimes against God and Man than this petty infraction of ettiquette, and they aren't going to let the public peek at the obscenities behind their curtain until much much more is at stake.
In the Judge's Dilemma, the judges will all support Aleman or all turn against her. But if they start to pull the old Good Judge/Bad Judge routine, just remember: Even Caligula tried this. It Didn't work. There is no "good judge."
Especially around here. Either a lot of judges with learning disabilities or unbelievable and imprudent arrogance. One thing about it, it catches up to them sooner or later one way or another.
All of the Judges who are testifying for her are there as experts in a particular area except one judge. There is only one listed who is going to take the stand and sing the praises of her character, Seidman.
Prosector: So you are here as a witness regarding the good character of Judge Aleman?
Seidman: Si senor.
Prosector: And you believe yourself to be a good judge of judicial character?
Seidman: Si Senor.
Prosector: And would you adjudicate yourself as being of good character?
Seidman: Si Senor.
Prosector: Would you then please read aloud the highlighted portions of this Miami Herald article? Please start at the section regarding you intentionally misleading the Judicial Nominating Committee regarding your treatment of alleged undocumented immigrants.
Seidman: Yo no hablo ingles, senor.
Prosector: No hablas ingles? Can someone please get me INS on the phone.
Ha Ha!
Great Post! Very Creative
Think it was Diaz that was disciplined, fined fifteen thousand dollars which remains the cause of the continued stinging, suspended and required to submit a written letter of apology by the JQC for the offense, not Seidman. What a ditz! Word is there's more in the hopper for this slow learner.
He should have got a refund. He was right in the end. Much worse for a judge to lie about mistreatment of hispanics then sending a silly email. Who gets an unpleasant email and runs to the FBI anyway?
That must be you ADJ. More tomorrow tomorrow tomorrow... what's in the hopper....NOTHING.
