    Maybe wanting to have medical testimony wasn't a ridiculous request.

    Anyone think that if Michelson hadn't said to the court that he wanted a 6 month furlough and instead merely requested a 60 day furlough (coinciding with the amount of time the guy supposedly had left) with a status hearing at that time, the judge may have ruled differently?

    Anyone else catch the fact that he was asking for a furlough for 3 times as long as the doctors claimed Mr. Felix had left was because the PD didn't want to have to check in with their client for his medical status?

    You make great points. She could have done things in a nicer way but the facts are still the facts this "dying" guy lived over 2 years. She was right to ask for a medical opinion.

    He had been sentenced. The PD acknolwedged the Court did NOT have the authority to modify the sentence at that point.

    So he had been validly sentenced to 8 months on a VOP and they were requesting a furlough so he could die at home since they argued he only had 2 months to live.

    WHY won't anyone address the fact that this whole discussion would be moot if the PD had actually made the rational request for a 2 month furlough (the time they claimed he had to live) with a status hearing to take place at that time regarding his condiiton??????

    Michelson's comment is very telling about this.

    HE DIDN'T WANT TO HAVE TO FIND OUT HOW THE CLIENT WAS DOING AFTER 2 MONTHS.

    HE ORIGINALLY DIDN'T WANT ANY SUPERVISION TO TAKE PLACE OF THE CLIENT (and only agreed once the ASA made the comment on that issue).

    The criticisms of Aleman on this case could be legitimate if the PD hadn't put his foot in his mouth over how much time the guy actually had and tailored the request to that uncertainty in the first place.

    The "hot story" on this matter was that a judge was condemning a guy to die in jail.

    Had this been ANY other judge, there would not have been this hoopla.

    you can sit here and try to justify this malicious behavior but the bottom line is that she was WRONG. there is no excuse for leaving someone to die in jail. maybe if she didn't make the hospice crack she'd have better footing to stand on.

    and, if she wanted the records so badly, why didnt she reset the hearing for the next day to get them? why didn't she reserve ruling on the motion till she got them?

    oh, i know why--because she had every intention of letting a MAN DIE IN JAIL.

    last point then i'm done with this--doesn't it say something that CJ Dale Ross stepped in and let the guy out. he's not exactly warm and fuzzy. hmmmm.

    The JQC Complaint (eventually dismissed) was that after the Sentinel article came out bashing her on her decision, her final order was tailored in essence in response to that article.

    That complaint was still dismissed anyway.
