CONWAY MAKES THE WALL STREET JOURNAL

The Wall Street Journal blog published an article today concerning the situation where the Florida Bar has filed five counts against Mr. Conway in response to his writings here about Cheryl Aleman.  Not only do the local comments in the Sun-Sentinel seem to support the proposition of 1st Amendment rights, but after reading the comments on the Wall Street Journal, it seems to be the national position also. 

This should become a hot topic, which I believe will become a national discussion, picked up by national broadcasts.  Our Courthouse is not new to the national spotlight, and any external coverage will be welcomed. 

During a time in our Nation where there seems to be an erosion of individual rights, it seems those who are in the profession of protecting those rights, namely lawyers, have instead abandoned their mission and surrendered their own 1st Amendment rights in the process.  Daniel Webster once wrote, "you can take away all my rights, but leave me the right to speak freely, and with that I will win back all of the others".  The Florida Bar should take a lesson from Mr. Webster.

    It's odd that Hilly Moldof can be involved in the inappropriate potential buying off of a witness in a murder trial and just gets a reprimand, and SConway may wind up getting worse just commenting about JAleman.

    What Conway did is no different than gossiping around the water cooler or on the playground. He’s coming out as a hero or champion of First Amendment Rights when in fact he was just whining because Aleman ignored him. What will be interesting to see is how Sean's abilities as a trial lawyer will be portrayed. Has anyone ever seen Sean try a case?

    So when are JAAB officer elections? I would nominate Sean Conway for President of JAAB. Hopefully they can pay him a salary so when he loses his ability to bill clients during his suspension, he will still be able to pay the rent.

    All lawyers have some thought in the back of their mind when they get their license that some day, people would know their name for something they did in their practice. Most people hope it would be as a result of winning a big case or being involved in something important.

    How does it feel to get fame and celebrity (fleeting as it may be) for basically calling someone names?

    A lawyer who called a controversial Broward County judge an “evil, unfair witch” in a blog post is facing ethics charges for his online tirade.

    Lawyer Sean Conway told the South Florida Sun-Sentinel that he wrote the angry blog post because Judge Cheryl Alemán was giving defense lawyers only one week to prepare for trial. The post criticized Aleman’s “ugly, condescending attitude" and questioned her mental stability.

    Now The Florida Bar has found that Conway may have violated five ethics rules, including a ban on impugning the qualifications or integrity of a judge, the newspaper says.

    Aleman herself is on the hot seat. The Florida Judicial Qualifications Commission has accused her of bullying defense lawyers and violating ethics rules that require judges to be ''patient, dignified, and courteous,” ABAJournal.com noted in a prior post. She is awaiting the findings of a three-day hearing.

    Conway’s lawyer contends Florida ethics rules restricting lawyers’ comments on judges are vague and overly broad.

    this isn't b/c Sean just wanted to call her a b---ch for the hell of it. Aleman was breaking the law (or a Rule of Crim. Pro. actually), and thought she could get away with it (evil). He exposed her in non-boring words b/c those are the ones that get the msg across (rather than posting some diatribe in a law rvw article, or hoping the "Bar-approved" words would be stumbled upon).
