"In the nearly 20 years since Victoria Sando was paralyzed by a suicidal ex-boss who shot her five times in a parking lot, the 55-year-old Dania Beach woman has had days when she thought life could not get any tougher.
But that was before she was rousted from bed at 5:30 a.m. last week and taken to the Broward County jail on orders of a circuit court judge who slapped Sando with a six-month sentence after she failed to show up for a hearing on a domestic battery complaint.
And in jail is where Sando remained Friday, without her motorized wheelchair, her service dog Fudge, her glasses or, as yet, any opportunity to appear in court and be represented by an attorney...
"This reminds me of a foreign country where there are no rights," said Broward Chief Assistant Public Defender Steve Michaelson. "Without a hearing, she went directly to jail, just like in Monopoly. Do not pass go, do not collect $200."...
Sando's case is unusual not just because of her physical condition, according to Michaelson. Typically, when a defendant fails to appear for a civil court hearing, the judge orders the police to bring the missing person into court.
But along with her order to have Sando picked up, Judge Marina Garcia-Wood sentenced her to six months in jail. The judge added a provision that Sando could get out of jail in 60 days if she took a course on domestic violence."

"Kovanes, 36, was originally charged with grand theft, organized fraud and money laundering, a mix of second- and third-degree felonies.
Prosecutor Michael Horowitz refiled the charges as first-degree felonies on Thursday. The new charges carry stiffer sentences.
Horowitz declined to say Friday why the Broward State Attorney's Office chose to upgrade the charges now in the 2-year-old case...
On Friday, Kovanes stood quietly by his attorney, Michael Metz, during a brief hearing before Broward Circuit Judge Pedro Dijols.
Metz requested the trial be delayed until March to give him time to hire a $200-an-hour forensic computer expert. Because Kovanes is indigent for costs, taxpayers will foot the bill.
"Whether your expert is ready or not, we need to rock and roll on this case," the judge said, adding that two years was plenty of time to prepare for trial."

How was the Judge supposed to know of her medical condition? Is it listed on the Petition or Order? The woman was served and didnt show up to Court. If the woman contacted the Judge and explained her medical problems I doubt the Judge would have dont what she did (considering the bad press alone). I know its a tough one to swallow around here but there is a thing called personal responsibility.
Due process? Same less rights someone gets on a VOP, she had an order for domestic violence against her and was found to have violated it. I know its hard for Michaelson and the rest of the PD's office to understand due process since they dont care about the due process rights of Broward's Homeless.
Looking at the Clerk's website she was served with the Order of Contempt on Dec 20 and was not taken into custody until 12-31. So did she get a lawyer, call the PD, send a lett to the Judge (nothing in court file)? No. Judges in DV Court do not Order the person to show up in Court. How would Steve know whether they do or not because the PD's office doesnt care about those people's due process rights either.
I bet this woman called the PD's office and they ignored her waiting for her to be taken into custody so they could take this to the press.
I'm sure Bogenschutz has Leyritz in rehab already. Now he'll take 40 continuances while the guy completes every program in the world and settles with the victim's family for big money. Oh yeah, the SAO will probably give old pal David a filing charge of DUI SBI to boot. Hey, 10:50am, check out your facts. BSO's computer says the poor lady didn't get arrested until 12/28, a Friday and according to the article she wasn't told why she was in jail for 3 days. She also never went to court or appeared before a magistrate judge, so the PD would have no way of even knowing she was in jail. It doesn't say what day she called the PD, but if the PD filed a habeas in the 4th DCA on Wednesday the 2nd or Thursday the 3rd, that sounds like pretty good service to me, considering Tuesday was New Years Day.
As far as the homeless, give it a rest. Everybody knows that Howard has done more for the homeless by refusing those BS municipal ordinance violations. It has forced the cities to rethink their policies and now it appears the county is ready to start charging the cities for filling up our county jail. Most intelligent people know the homeless community supports Howard, that's why they give him awards for helping the homeless.

It's like they use this contempt power as their way at getting back at society. Just because they're stuck in a dead end job with a never ending stream of frustrating litigants they have to take it out on the poor slobs before them. It begs the question: who is the truly weak person, the serial lawbreaker in court or the one with the power vested in them who can't handle it in a humane fashion with integrity and honor?
Maybe Tobin and Holmes should do a crash course for the other judges on contempt procedure. They are the self proclaimed experts in contempt who were to testify for Aleman, right?
I wonder if Mardi would have given a woman in a wheel chair 6 months for missing court?
People, people!! Don't you understand what a flight risk she represents if she is not in jail? Paralyzed legs and one arm not withstanding, she could melt away into the general population in a flash! How could she be found? We don't need her on the loose subjecting another Florida city to her reign of terror.
Why did Garcia Wood even have this case? She is listed a Juvenile Dependency Judge on the 17th site. Was she covering? Is she capable of doing any other kind of law besides juvenile? Did she take any courses or study domestic violence before hearing this case?

I have a friend that was held a YEAR in jail awaiting trial for a burgulary/battery...and A WHOLE YEAR LATER they decide to check the evidence and fingerprints and see they werent his...He was cleared and charges dropped a month later. The state attorney knew it wasnt him and still kept him incarcerated just so he didnt look bad...

This is shocking--this disabled woman gets six months in jail for what? She maybe dented someone's van? What happened to due process? She didn't show up to court, yes a mistake, but this is extreme. And she can get out of jail in two months if she takes a program. I've know men who have beaten up women half their size who got far less time and punishment that this.
Kudos for her good attitude in jail, and her prayers that she gets out of jail pronto so she can go back home to her dog and rabbit, both of whom probably have more sense than this judge.

When some poor gal has a maniac threatening her, it takes them days to enforce a restraining order. We have even seen women killed while waiting to have the courts act. What really irks me is the fact that this woman is paralyzed and the police "removed" her from her bed at 5:30 a.m. She is without her motorized wheelchair..........which means she can't AMBULATE. Why? Because Marina Garcia-Wood belongs to the same club as Jenne. For all practical purposes, the entire Broward County apparatus can be seen as belonging to one big club in which Jenne was one of the kingpins. Wood- which was kind of deceptive...(don't you think?). Anyway, had you paid any attention to the the papers- you would have seen that Garcia-Wood was not as qualified as her opponent. Wow, it's hard to believe how stupid and uncaring some of Broward's Finest Judges can be when confronted with a situation like this. Do any of Broward's Judges have any sense at all? One after another seem to be desirous of being added to the list of imbeciles. No wonder not many of them were ever very good at practicing law. They don't seem to know what it is they're doing most of the time. Ask a real Judge like Marcia Beach what she thinks about this little desperata and her actions. Browrard County has a lot to learn about the judges serving in this circuit so we can rid ourselves of some of these clown politicians and clean the slate once and for all. This chick Judge Wood or whatever her name is must be a real piece of work. Vote her out as soon as possible.

The doing away of SPDs certainly put the hurting on any number of judge's sons and daughters. Zeidwig's kid was just one of them and most favored with the back room manipulations of the wheel. Now you never see the kid. Wonder how Papa explains that to his minions and shrinking fan club?
