"Broward Public Defender Howard Finkelstein said most Broward judges are good jurists and good people, but that was not the image projected to the world by the duo presiding over the Smith caper.

''We were the laughingstock of the legal community nationally,'' he said. ``There is no other way to say it. We were the butt of the jokes.''

JENNE TO APPEAL DECISION:
http://www.sun-sentinel.com/news/local/broward/sfl-flbjennepension0208sbfeb08,0,5207594.story

"Jenne applied for his pension on the same day he resigned, but the state immediately froze his account while officials investigated the case...

"We are going to challenge their decision," said Mark Herron, Jenne's Tallahassee lawyer. He said he was still researching the grounds for an appeal.

Jenne must now ask the state to appoint an administrative law judge to consider his objections. Such cases are usually resolved by a trial, Herron said.

"It's case by case based on the offenses people pleaded guilty to or are convicted of," he said."

BEN KUEHNE INDICTMENT HAS DEFENSE LAWYERS CRYING FOUL (UPDATED):
http://www.dailybusinessreview.com/news.html?news_id=47035

“It’s now official: It’s a crime to be a criminal defense attorney,” Miami criminal defense attorney Milton Hirsch said. Referring to Kuehne’s courtly, buttoned-down demeanor, he said, “They picked a guy who sleeps with wing-tipped shoes on and indicted him for going above and beyond to make sure legal fees paid to a different lawyer are clean.”

Jon May of May & Cohen in Fort Lauderdale distributed a statement saying the case represents the first time charges have been brought against a lawyer who offered advice about compensation.

“To target an adversary like Ben Kuehne, who is held in such high regard by the community and whose integrity is unquestioned, sends a message that any lawyer is at risk,” the statement said."

You can't blame the problems of the Broward Judiciary on Judge Larry Seidlin. The problems had been building for a long time. Dale Ross gave the license to judges to act any way they wanted with immunity from any criticism for years and then protected them when they got in trouble. He also hand more than a hand in stacking the judiciary with friends and family. Those are the facts whether you like them or not.

    THE FLORIDA BAR,

    v. Case Numbers SC 07 - 80 and 07- 354

    JOHN B. THOMPSON,

    Respondent.

SUPPLEMENT TO RESPONDENT’S VERIFIED MOTION TO DISQUALIFY REFEREE TUNIS

COMES NOW respondent, John B. Thompson, hereinafter Thompson, on his own behalf, and supplements his motion to this court to recuse herself from this matter, stating:
Has Dava Tunis lost her mind? Apparently she has.
It would be bad enough if she were to have accepted a campaign contribution from Ben Kuehne before she became the referee herein and did not disclose that fact, but it is far worse than that.
What she did was receive and keep a donation from Ben Kuehne AFTER
this Bar matter was assigned to her and AFTER she was told by Thompson, in writing, that Kuehne had received a target letter which has now resulted in his indictment by the federal government. Can a judge legally, ethically receive a money gift from someone after a case in which he is involved is assigned to her? Of course not.
I solemnly affirm, under penalty of perjury, that the foregoing facts are true, correct, and complete, so help me God.
I HEREBY CERTIFY that this has been provided this February 8, 2008, to Bar staff counsel Sheila Tuma, to Kenneth Marvin, Director of Lawyer Regulation for The Bar, and to all Bar Governors as well as to Bar President Frank Angones and to the JQC.

I'm never happy to see someone lose (in most cases) their hard earned pension. But Mr. Jenne is an exception. As Sheriff and in control of the largest budget in Broward County, Former Sheriff Jenne betrayed public confidence as well as people everywhere that had placed their faith in him. We prosecute and incarcerate thousands of poor and mentally ill people every year. And yet many times when it's a public official that breaks the law, we tend to look the other way when politics becomes part of the very process to argue leniency and compassion for their prior public service. I can't feel very compassionate for someone who was obviously smart enough to do well in the practice of law for as many years as he did and then go on to run the political gambit to become sheriff of one of the largest counties in the State of Florida. A line must be drawn when people with whom the public has placed its trust turn to paying more attention to feathering their own nests than to the responsibilities with which they are entrusted and already being paid for from public coffers. I know it's probably overly optimistic to say, but I hope this example of a public official serves to remind others that the sword of justice can and often times will cut both ways, whether you can afford to have brilliant legal representation or not.

He has affirmed under penalty of perjury that his statement that Judge Tunis has apparently lost her mind is true.

I'd have to agree with Thompson on the above subject as well. Once these people are in public positions they think they an get away with anything because by the time it reaches some oversight committee it's so watered down that it doesn't resemble the truth anymore, particularly the findings most often. I applaud him for taking a stand against public corruption which is more than most of these people ever do.

Broward's Judiciary has always born the brunt of crude jokes around the State. The only ones that don't seem to care are the judges. The Anna N. Smith case just brought it bubbling up to the surface of the national media. Ross couldn't keep a lid on it any more. And then he went down. But we can still honor him and his cronies this Tuesday for all their good work over the years. It'll be worth the ten dollars just to see the looks on their faces. Got an idea on a plaque to present. It'll be in a bag. Woopy cushions for them all to remind them of the legacy they've left.
