Skulking around neighborhoods looking for ex-boyfriends underlines a much deeper problem than 300 dollars worth of property damage and the resulting damage control effort of a Circuit Court Judge. Moral of the story to Gardiner (this time) should be to keep her eyes on the road, as well as her car, and her thoughts focused on the cases she's hearing with an eye toward her responsibility to the public. Reminds me of O'Connor not long ago slipping up and envisioning a certain attorney appearing before her with his shirt off. What's on these people's minds anyway? Guess it's fairly evident to anyone hearing the evidence. Gardiner got lucky this time. Hope she learns for the incident and gets her priorities straight. Chasing around ex-boy friends isn't going to do anything for her reputation but make people wonder if she's not in the wrong business being a judge, let alone Chief of Criminal Judge. Whoever gave her the advise to return to the scene of the accident did her a favor and should be commended for remaining calm and level headed under the circumstances. Guess we can all guess who it was. Things could have gone much differently for Gardiner. She gets to skate on this one which is more than I can say for most of the defendants that appear before her.

Typical of the Broward Judicial Political Machine; berate and belittle the individuals' whose property was damaged as a result of another errant Broward Judge letting her mind wander to parts unknown, or in this case at least from witnesses at the scene, known all too well. Gardiner as a public official should have at least offered an explanation or apology to the owners of the vehicle, unless she was unable to or had been advised not to step out of her car? Something smells here and it's a smell that's come to be recognized from prior exposure.

Boy, you attorneys are just a bunch of complainers. The judge did not leave the scene, faced the incident like a law abiding citizen she is. Received a ticket and should hire one of you to handle the matter for $79.00. Isn't that what you do?

At least she wasn't injured in the accident. Those two bags she had put in a few years back surely saved her from serious harm.

Who cares what the cops wrote in their report. If she left, whether or not she came back, and if there is a witness to her leaving (witnesses?), she committed a crime. If the Warhaftig person hires a lawyer and presses Satz I think he will have to file misdemeanor charges, or he might have to ask the governor for an executive assignment if he's reluctant to do it himself.

Judge's fender bender no crime, cops say

Posted on Fri, Feb. 15, 2008

A Broward judge didn't immediately stop after bumping fenders with a parked car on Super Bowl Sunday -- but it wasn't a crime, according to police.

Ana Gardiner, chief judge of the criminal division, will not be charged with hit-and-run, Fort Lauderdale police say.

Gardiner bumped into an unoccupied Mercedes owned by My Warhaftig in the 700 block of NE 25th Way, and did not immediately stop.

Witnesses told Warhaftig that Gardiner made no effort to stop after the collision. But police believe Gardiner continued driving because she saw a police cruiser on the next corner.

The judge had intended to report the accident to the officer in the car, but the police vehicle was empty, said Detective Kathy Collins, a spokeswoman for Fort Lauderdale police.

She drove around the block and returned to the accident scene, where she parked and waited for the police to arrive.

Reached by phone Friday, Warhaftig reiterated previous statements claiming Gardiner left the scene of an accident. She did not address the fact that the judge was waiting there when police showed up.

The accident occurred on Feb. 3 at 7:50 p.m., according to a police incident report.

Gardiner, who was driving south on NE 25th Way, told police she was looking for addresses on her left, and didn't see Warhaftig's 2008 Mercedes to the right.

She bumped the Mercedes, causing $300 worth of damage to both it and her BMW.

Police charged the judge with failure to use care.

''To make it clear, the investigator had no idea that she was a judge, and she never identified herself as a judge,'' Collins said. ``We handled it like any other accident. Any implication that she got special treatment is wrong.''

Warhaftig said she has no plans to sue Gardiner.

Efforts to reach Gardiner for comment were not successful.

Speaking of exoneration, Judge Ana (Speed Racer) Gardiner of North Of the Border and reckless Mercedes driving fame, has been cleared of leaving the scene of an accident. Apparently there is an exception to the Florida Statutes, if you are a Judge, and after you drive away from an accident an angel appears on your shoulder and says "hey, stupid- you're committing a crime" and you quickly return to the scene

Wasn't quite so easy to pull the disappearing act this time! If you need to check up on ex boyfreinds, try the cell phone. That normally doesn't involve property damage and you can't be accused of leaving the scene of an accident.

What happened to the BS idea that you can sue a judge--doesn't it have to go before other judges? Isn't skulking around and stalking exes a judicial perrogative as part of her official duties as opposed to anybody else when it becomes a sexual predator offense when Gardiner presides. Ever heard of investigation?
