As many of you know, attorneys in ROC Court are seeing many cases where the State Attorney's Office is pulling recordings of jail phone calls that Defendants are having with their friends and family. Incriminating tapes of Defendants’ jail phone calls are regularly being listed in ROC discovery.
It is only a matter of time before this practice spreads to the regular divisions, if it has not already.
Advise your clients that calls from jail are recorded by BSO and can be used against them.
Guys at my high school used to record jail conversations of the accused all the time, it was no big deal.
Could it be that our little Ratboy, tired of not having any legal career to speak of, is actually contemplating a run for Judge?
Heard from a couple of people that Ratboy was at the DoE picking up a filing package. He was also seen having lunch with Political Consultant Dan Lewis, who is running John Howes' judicial campaign. I guess he's hoping that Lewis can help him garner some of the criminal defense bar support for whatever race he's going into.
Or is he merely trying to get some judicial love from the bench by becoming the 2nd Jew in the Dijols/Bober race to leech some of the vote away from Bernie, resulting in Dijols' reelection.
If this is the case, it is the worst sort of maneuvering and crass political calcuation ever.
Ratboy, if you ever expect to be given the time of day by anyone in this town again, throw out that filing packet and get back to doing what you do best -- hearing coverage.

ARE YOU KIDDING ME? We need a blog like this to tell us to advise our clients not to talk on jail phones? If lawyers don't know that already, then they have no business taking criminal cases. But I guess that's exactly it. The quality of lawyering in Broward has been steadily declining over the past few years.
Didn't B. Simon already sue BSO over this? I am serious I thought he won.
Those were attorney-client calls. These are client calls to their people.
Broward's old SPD pigs (you know who)WANTED the clients to incriminate themselves on tape. One pesky trial can spoil a whole week you know.
Man, what y'all should be worried about is all the attorney client lists the drug dealers and prostitutes chat about on those lines. There be some craziness goin' on if half of what i've heard be true.

Hey 1:27 I have handled thousands of cases in Broward and never had them spring a tape on me. This sucks.

Whether a tape has been used against you or not, it's basic common sense to tell your clients not to discuss their case with ANYONE whether over the phone, with their fellow inmates, or anyone else. It's also prudent not to let them keep their discovery if they are in a pod with lots of other inmates, so others don't read their reports. It's one of the first things you should tell any client...keep your mouth shut.

They don't need a tape if all you do is take pleas. You say you've handled "thousands of cases in Broward"? If it's that many, I doubt you've tried very many of them.

I am an ASA and I am sick of these stupid "Ratboy" comments thrown into every blog post. I have dealt with Brian Simon on numerous cases and I find him to be an honest and hardworking defense attorney. He is always professional and courteous to me, more than I can say for some of you. Leave the man alone. Grow up and talk about the issue of the post and not petty childish comments thrown into every post.

how bout the jail notifies them that they are being recorded and that they still discuss their case with their friends...there's a reason why they're locked up in the first place.
