                                                  The trouble is I need you several times a week...

As many of you know, attorneys in ROC Court are seeing many cases where the State Attorney's Office is pulling recordings of jail phone calls that Defendants are having with their friends and family.  Incriminating tapes of Defendants’ jail phone calls are regularly being listed in ROC discovery.

It is only a matter of time before this practice spreads to the regular divisions, if it has not already.

Advise your clients that calls from jail are recorded by BSO and can be used against them.

    If this is the case, it is the worst sort of maneuvering and crass political calcuation ever.

    Ratboy, if you ever expect to be given the time of day by anyone in this town again, throw out that filing packet and get back to doing what you do best -- hearing coverage.

    Whether a tape has been used against you or not, it's basic common sense to tell your clients not to discuss their case with ANYONE whether over the phone, with their fellow inmates, or anyone else. It's also prudent not to let them keep their discovery if they are in a pod with lots of other inmates, so others don't read their reports. It's one of the first things you should tell any client...keep your mouth shut.
