When you report stories, there are some facts you report and some you don't. Sometimes they don't add to the story, sometimes they aren't 100 percent nailed down, sometimes you have strategic reasons to hold them back until later.
Well, in this case, I just forgot to put it in the story. The article in question is "Judging Ana" which some of you have been clamoring for on this blog during the past couple weeks. Well if you read JAABlog, you know it's out. If not, click above to read it. Also, read this for a little back story on my interview attempt with Gardiner.
The fact in question is a remark Sheila Alu says Gardiner made on the phone before they met at Timpano's. Alu says that Gardiner told her on the phone, "I'm with someone I'm not supposed to be with."
That someone was prosecutor Howard Scheinberg. Read the article and you'll know the significance.

Hard to believe that such a seasoned journalist like you, would forget such a critical piece of information. Who do you work for again - the High Times or the New Times? Oh yea, the High Times I think actually charges for their newspaper - rather than having to give them away.
Aren't you the same reporter who utilizes his cell phone camera to take pictures for your newspaper? I think I remember you obnoxiously sticking your cell phone in Wasserstram’s face during his trial - quality journalism at its best.
If this story or this reporter had any credibility - wouldn't other media outlets have picked this up? Let's put some perspective on this - other than the defense attorneys and some SAO's, exactly how many people do you believe actually read this story.
Hopefully, as this story dies down and goes away, Norman will do the same. Leave the reporting to the real journalists – like Tonya Alanez.
State Attorney Mike Satz is now on notice. A member of his office, Howard Scheinberg, is alleged to have had improper communications and perhaps a relationship with Judge Gardiner while he was trying a capital murder case in front of her. Mr Scheinberg's denial rings very hollow.
Will Satz have his office investigate this? Has Scheinberg given a sworn complete statement? Has he been polygraphed and if so, did he fail? The public must be told the truth. Mr Satz you can not use plausible denial on this one. Mr Satz do the right thing. It's well known Howard Scheinberg is a good, dear friend of yours. Do not get caught in his attempted cover-up.
You forgot what would have been the most important fact of the story? Way to screw this wole mess up. Whatever credibility you had is just about gone.
This story is not going away. It's only the beginning. Some advice to the parties involved, the sooner you all come clean the faster you can move on with your lives (and maybe save your legal and judicial careers) It was the cover-up that took Nixon down.
That's right. Satz is a firm believer in the poly. A man is on death row. He may have a bad apple in his organization. Mr. Clean needs to poly Scheinberg now.
scheinberg made his career in the state attorney's office by, among other things, being that racist misogynist Futch's lead prosecutor. anyone who learned from Futch is prima facie suspect.
Wasnt Seidman a lead ASA in Futch's division?

Mike will win any elwction easy but he still doesn't want an opponent. It's work and you have to spend your supporters money which makes no one happy at the end of the day.

Probably it is best to be wary believing too easily clipped-memories recounted by others. It is difficult, for me at least, to embrace the comments of a gossipy purported 'friend' about a liason in a bar. First, a 'friend' would not do that, so we know the story is lopsided from the get-go. More importantly, I've known the prosecutor in question for so long (though we do not socialize at all) in a professional capacity. He is unequivocally 'ethical.' Thus, the alleged 'ex parte' event is not likely to have happened at all. More likely is that friend-Alu drank too much and had a dream - or just smelled a chance to deelevate her 'friend' the judge in the midst of an opportune 'sex scandal' expose. Geez - aren't people great animals? I rather prefer a dog as a companion. I would also note that the reporter of these of these 'events' may ought to focus his enthusiastic bent on the kind of sentences MANY of the judges like to impose, rather than how many sex partners one has - there is plenty of shame in sentencing policies of our courts which warrants investigation and it touches a real and important social issue. Hey, I'd love to screw Gardiner - and she doesn't even have to appoint me, rule in my favor or talk to me in a bar about a case. That's because sex is good baby. Leave the lovers alone. Let them play. Heck, Gardiner is going to give a harsh sentence anyway whether she's screwing the defense lawyer or the prosecutor. Methinks there is no advantage but the experience of caressing a tight little Cuban girl's body and experiencing the....oh well, you know what I mean.

Law is too important to leave to lawyers and the corrupt judges that are so well tolerated by BROOKE ''lapdog'' KENNERLY of the JQC....... the embedded courthouse reporters do a poor job investigating the systemic corruption of THE BAR........ senator JOHN McCAIN says we are in IRAQ to bring the RULE OF LAW........ We don't have it here because the lawyers undermine it with their complicit silence.

Screw Gardiner. No matter the outcome, the SAO has a turncoat in it. Someone who just can't be trusted. Can you say career satellite. Write her name on one of the blocks in the parking garage at North. The whistle blower radar just went off the chart. This is the SAO...NO SNITCHIN!...Mike what are we going to do?

The head of County Court...Adonis...I mean Lee Cohen has a very new skeleton in HIS closet..While all you fiddle with Judge Ana, Rome is burning with a scandal all its own. I am surprised no one has yet picked up on it!!! as there is a very hush hush and low buzz...Apparently Mr. Cohen has violated the State Attorneys sexual harassment policy by having an affair with one of his subordinates, apparently making numerous trips to the North Satellite Court House for midday trists. This of course only comes to light when his mistress is transferred back to county court and other subordinates are a little jealous of her special treatment.
Lee Cohen is one of the most outstanding examples of integrity in action in Broward County. Quit trying to muddy the water with what's going on with Gardiner.
The real story there is the cover up by Satz and Chuck Morton. Bob Norman, do a public records request for movement in the office. All the ASAs in county court have been reshuffled out of there in the hopes, by Satz and Morton, the story would die.

Lee Cohen is one of the best we have. Knock off the bull. He's a fine attorney and a brilliant supervisor in the SA's office. He forgotten more about the law than most of us have ever known.
Lee has violated F.S. 798.01. Appoint a special prosecutor to investigate. They do for everything else. He also has broken several commandments. Where is Moses!!!!! Where is his morality!!! Its someone he supervises!
This is just out of hand. To attack Lee like this, whether you like him or not, is ridiculous. Anonymous attacks that are forever memorialized on the internet are not what any blog even this one should be about. There has been no story about Lee justifying comments. Lots of people have taken hits on this blog, but this line of comments is actionable even if true. Florida's libel statute has several parts, but the following is most pertinent:
Any individual who publishes a libel is guilty of a first-degree misdemeanor. Fla. Stat. § 836.01 (2005). Additionally, when the libel is anonymous or pseudonymous, the editor, owner, manager and/or publisher of the publication in which the libel appeared may also be guilty.
Case law, specifically State v. Chase establishes the "truth is a defense" doctrine to apply only to public figures (Lee isn't one). So, maybe it's time to go to Court.
Thanks for the legal education but before you go cast your stones..how do you justify the Article that is all over this blog...Are Scheinberg, Potenza, Cutrone public figures. Judge Gardiner, questionable, Mr. Cohen just like the others. If he is in a position of trust then he is held to a higher standard. Read the sexual harassment laws. If I am not mistaken before each state attorney agrees to work at the office they must sign a document about these sexual harassment laws.
I agree OWL -- let's get some investigations rolling. And call in a special attorney to supervise the process - like Scotty Sherman. He's got the experience as a prosecutor in Ocala and is well-respected throughout the courthouse.

I wouldn't have as much of a problem with an accusation if it weren't anonymous. Pretty soon you guys will be okay with criminal trials not allowing the defense to cross-examine. Why be allowed to confront your accusers? It's no big deal. Right?
