FOLLOW-UP TO JUDGE GARDINER ARTICLE

Because I believe it is highly unlikely that Broward State Attorney Mike Satz will take the necessary steps to uncover the truth in the controversy involving his friend Judge Gardiner and his prosecutors, it is once again up to the rest of us to make sure justice prevails in Broward County.

Therefore, I am preparing a witness list for the JQC for an investigation of Judge Gardiner. I am looking for information, evidence, or witnesses who can prove or disprove allegations that the Judge and certain Assistant State Attorneys (whether or not named in the New Times article) may have compromised criminal prosecutions. Please email me at wgelin@yahoo.com with the heading "Re Judge Gardiner". You can also send information through the "Anonymous Tip Box" or through an anonymous email address, or through a comment on the blog.

Additionally, I am preparing public records requests for the State Attorney, the Public Defender, the Clerk of Courts, the Department of Corrections, and BSO. The goal is to compile a list of current inmates who may have been improperly prosecuted or who are currently being prosecuted before Judge Gardiner. I will do my best to assure they receive a copy of the New Times article, so they may pursue or preserve any remedies that may be available. I am also interested in contacting individuals who may have completed their sentences, though I feel current inmates should be the priority. If you have the name of an individual defendant who you feel may have been mistreated, please send the name and case number along.

I will also be contacting the Supreme Court, The Innocence Project, The CCRC, and federal authorities on the death penalty issue. I would appreciate it if anyone experienced in death penalty matters could contact me with additional suggestions on how to proceed with this particular situation.

The death penalty allegation, if proven, would have to rank as the most egregious malfeasance by any judge I have ever heard of.  However, as serious as the death penalty matter may be, I believe the allegations regarding Mr. Patanzo, the former lead prosecutor in Judge Gardiner's division, warrant even greater scrutiny.  The sheer volume of defendants who may have been impacted, to say nothing of the tenor and inexplicable zealousness of the pre-ROC prosecutions and sentencings (which often required action by the 4th DCA), demand it.

Lastly, I call on Judge Gardiner to come forward immediately to publicly refute the allegations or to admit them in the interest of restoring integrity to the numerous prosecutions that may have been compromised. Judge Gardiner is, of course, entitled to the same protections as any judge accused of wrongdoing. However, most JQC proceedings have to do with aberrational behavior by judges that typically does not impact prosecutions. In this situation, a man’s life hangs in the balance, and hundreds, if not thousands, of prosecutions have been called into question. I therefore hope that Judge Gardiner will subordinate her individual rights to the greater need of restoring integrity to the Florida and US Constitutions, which will remain tarnished until the Judge and the Broward State Attorney’s Office are cleared of all allegations.

Bill Gelin

    Mr. Gelin,

I read this blog every once in a while, somethings I like, many I don't. I am not a fan of yours. I am a part of the Broward legal community and have been for quite a while. That is a very bold and courageous post. You are a better man than I am.
Do not relent. I suspect you are going to be attacked, vilified and stonewalled by many endlessly. Again, do not relent. In the end justice must prevail.

Amazing. Bogenschutz and company will do all they can as defense attorneys. As they should. But will the truth come out? What if it is true and they can't prove it? She remains despite all the rule breaking? What does she end up doing to the system and to all the judges in Broward forever if she is guilty but remains simply because it can't be proved? I hope the truth comes out. I don't know if it will though.

If they do a new death trial will run 400 grand and opening all those other cases will cost a fortune. The lawyers have liability too. I don't know where the truth lies but the fact is if they did it they will mob up and stonewall the truth from ever coming out and the authorities won't even care.

Systemic corruption seems to be a big problem here in Broward. The problem as I see it, is because it's so widespread it doesn't bode well for anything getting accomplished because it's set up to protect and serve only those that are embedded in it. It's really lopsided justice to prosecute those from the lower strata of the economic ladder and then allow those at the top to make every conceivable excuse for themselves and then be able to count on their friends that sit on other entities to smooth over the problems they face when they find themselves in trouble. We've seen it before many times. Look at this last thing with Jene when all his political buddies came out of the woodwork. All but one I'm told, and they were such good friends. That is as long as they're not tainted in the process as always. Because the whole system is so enmeshed with those in power, the only hope for justice is for there to be outside intervention of some sort. The JQC doesn't police judges very well from what we've seen because they are all friends and buddies with agendas for further advancement or just self preservation behind it all. More's the pity for justice and the American way when this remains the case.

I think this idea of private people butting into governmental investigations is a damned good one.

In fact, I am inspired by Mr. Gelin to appoint myself the public investigator and prosecutor of FORMER General Counsel Laura Seidman and Broward Health regarding her "after hours" resignation as General Counsel for the Hospital District.

Who died and made me cop and prosecutor of Mrs. ADJ, you may ask? I did. Just like Billy Boy for Judge Gardiner (she's a fox, hubba hubba).

As a Broward County taxpayer, I have a right to know why I am continuing to (over)pay a General Counsel for the balance of this year -- approximately $200k for a job she isn't doing. In fact, I demand an investigation into why she got paid the last couple of years since she wasn't showing up for work then too. I mean, at least now we know she's collecting a paycheck for not showing up to work -- before now it was the same thing but just less obvious.

There is certainly misfeasance and/or malfeasance afoot.

Accordingly, I am calling upon patients at Broward Health (formerly North Broward Hospital District), employees, attorneys who worked under Mrs. ADJ (hope your backs aren't too hurt from carrying her workload until now) and administrators at the hospital district to contact me at MOCKTHEADJ@aol.com under the heading "RE -- Mrs. ADJ's Permanent Vacation" with information regarding Laura Seidman's activities (or lack thereof) as General Counsel of Broward Health and the real reasons behind her resignation/termination.

As Mr. Gelin is already doing for his own self-important investigation, I will also be contacting the Supreme Court, The Innocence Project, The CCRC, federal authorities, Bob Norman, the Peanut Guy at the Courthouse, Howard Stern, and Bozo the Clown regarding Mrs. Seidman. I would appreciate it if anyone experienced in self-important BS and witchhunts contact me with additional suggestions on how to proceed with this particular situation. While I know that Jack Thompson would be the perfect person to consult with on this, PLEASE DO NOT CALL ME!!!!

Lastly, I call on the ADJ and Mrs. ADJ to come forward immediately to publicly refute the allegations of corruption, malpractice, and other wrongful acts or to admit them in the interest of restoring integrity to the Broward Health Legal Department that has been so compromised. Mrs. ADJ is, of course, entitled to the same protections as anyone accused of wrongdoing. However, for the public good and to restore some level of confidence in the public health system, I therefore hope that Mrs. ADJ will subordinate her individual rights to the greater need of restoring integrity to her former office.

    VIVA BROWARD HEALTH!!!

Court: Mr. Gelin, are you ready for trial?

Mr. Gelin: Have I mentioned how out of whack Broward County statistics are compared to other counties – cmon Judge – he’s a drug sick, duck killing masturbator. Maybe you want to rethink that Downward, huh judge? Ha ha.

Court: Mr. Gelin, are you ready for trial?

Mr. Gelin: Sorry judge, need to take a continuance, I’ve been really busy with my self appointed prosecutorial duties. I know he’s been sitting in custody, but I thought this would plea, now I will have to read the file and take a deposition and all that other stuff – Can I withdraw?

Court: First, your continuance is denied. Second, your motion to withdraw is denied. Third, you can not go speak to your client to get yourself fired. Mr. Gelin this case is over one year old and you have not done anything on this file. You simply can not think all of your cases will plea – eventually you have to go to trial. I have read this file and there is little doubt in my mind that the state can prove their case. It is an extremely bad case for the state. Mr. Gelin, why are you trembling?

Mr. Gelin: (in desperation) – we will take the Plea. Judge how do you spell your last name and while we are at it can I have the prosecutor spell their last name too.

    - Later that day—

Dear Bloggers: I would like to draw your attention to an unbelievable situation. I was in Judge (X)’s courtroom and he denied by continuance, everyone knows how busy I am, especially with this self appointed prosecutorial detail. The Judge even admitted the case was terrible. I tried to tell Prosecutor (Y) how terrible their case was, but they would not listen. I even had the supervisor come down and still no help. This jail is filled with drug sick, duck killing masturbators and the state is wasting the resources of Broward county. I’m calling for change – SATZ must go and JUDGE (X) must go. Has anyone ever faced this situation? We must topple this new regime! Oops, JUDGE (X) is not Hispanic or other minority – so, I guess we will give him a pass.

Response: Why didn’t you try the case?

    ----Still waiting for a response----
