"Either this is related to the Judge Ana Gardiner expose or it's one hell of a coincidence. Scheinberg allegedly partied with Gardiner while prosecuting a murder trial in her courtroom and talked about the case over drinks at Timpano's.

If this is a sign that Michael Satz is cleaning house on the matter (or at least not circling the wagons around it) then I ask: What is Victor Tobin doing?

Who knows, but it looks like Broward's chief judge is sitting on his hands. The rumor is that he'd like to move Judge Gardiner out of her powerful administrative post (Gardiner is chief criminal judge) and into family court, but she's dug in her heels. Meanwhile, the Gardiner article has been sent to the state Supreme Court by Omar Loureiro's attorney and will almost surely become an issue in Loureiro's death penalty appeal.

Point: The truth will come out and when it does, Tobin will have proven that he's no reformer (unless it's politically expedient, of course) when it comes to Broward's battered judiciary. Instead, he'll have shown that he's just another Broward lackey without the guts to do the right thing."

    I don't know the truth behind the Judge Gardiner allegations but I dare say that no one else on this web site does either. A newspaper article in New Times certainly doesn't impress me as clear and convincing evidence or even a preponderance of the truth. Most of us have dealt with the press and been misquoted, slanted, skewed and misrepresented according to the angle that the reporter wants to write the story from.

    This site has really gone the way of gossip columns and witch hunts and kinda sorta lost its credibility for me and others whom I talk to. Some of the postings are well thought out and articulated - others sound the like the rantings of schoolyard kids who don't get enough attention and don't know how to behave.

    If the allegations of a reporter and hearsay evidence are true, then yes, Judge Gardiner has an issue that needs to be rectified. However, I refuse to crucify anyone based on a newspaper article and a reporters slant. If there is merit, report to JQC and let them investigate...otherwise, this site really needs to grow up a bit.

    Not judging anyone....just saying.

    It's not about whether it can be proved, it's about the truth.

    That tongue-lashing aside, whether the alleged relationship had an effect on her judgment is not the question, nor is its impropriety. The question is whether she should be completely removed from the bench.

    I for one, think she has redeeming qualities. She was made chief of the criminal division for a reason. I think she'll find it difficult to be re-elected even if this went away tomorrow. She did something stupid. So stupid. SO STUPID... but are we to throw her away for that?

    Bill Clinton got BJs from an intern and perjured himself. His approval rating actually ROSE. I'm not saying she didn't do something wrong; I'm disgusted with her. I do, however, think that she has a keen legal mind, one that can be of use to the judiciary in the future.

    Shall we throw the baby out with the bath water?

    With the exception of Cheryl "Take Your Kids Away Because the Bus Was Late" Aleman, the 4th DCA has so frequently reversed Judge Gardiner that nobody can in any way with a straight face say she has a "keen legal mind."

    The only thing she has is luck, (formerly) powerful friends, new tits and straight teeth (braces are wonderful).

    That and the complete absence of a soul.

    May whatever powers that exist in the universe have more mercy on her than she's ever shown to anyone.

    Second, if the article did not have any truth to it then I'm sure Mr. Bogenschutz would have made a statement to that effect. I know it is a delicate, sensitive situation and I'm not claiming to have the experience that Dave does, but there has been no response whatsoever (to my knowledge) other than a cease and decist letter.

    I'm not saying the players should be assumed to be guilty, but my opinion is that there must be at least some truth to the story. I don't wish any ill will on anyone. I know John and Pete and have appeared before Gardner. I hope it is not true, but if it is, something must be done. It is a very sad situation for the people involved and the entire judicial system.

    My understanding is the JQC has opened up a file on Gardiner re: the allegations in Norman's article. Gardiner should resign. The Norman story was only the tip of the iceberg. Scheinberg should be disbarred, or at a minimum suspended. And Charlie Kaplan better watch himself. Once the sworn statements start flowing the truth will come out and it's not going to look good for Gardiner and Scheinberg and maybe Charlie Kaplan.
    Warning to the JQC, Gardiner will fight this to the end, scorched earth policy. I suspect that Bogenschutz will withdraw when Ana starts telling him to do unethical crap. Ana's strategy will be deny, deny, deny and buy buy buy anyone in your way. Sheila you will promised many things by Gardiner to say you lied. We'll see what happens. I do know one thing, this County is better served without the likes of Gardiner and Scheinberg as judge and lawyer, respectively.
    Vic you should have stepped up to the plate and yanked Gardiner from criminal the day after the story broke. you still have a chance to do it, to do the right thing. Show us what you are made of. Some are already same that with you things are,

It is said since that time they have revisited several of the blogs and reposted the link. It is said that they ahve never experienced anythin of this nature and find it highly suspect. And I have heard that several people at the Sun Sentinel have been contacted in reference to this. This is a wild story
