"You probably will not see Circuit Judges Pedro Dijols and Dale Cohen sitting together and joking over coffee or lunch.

That’s because one of Dijols’ two challengers in the Aug. 26 election is Mardi Levey Cohen, Judge Cohen’s wife (She dropped the Cohen for the ballot.).

Asked how awkward it is to have the wife of one of his judicial colleagues — who also serves in the criminal division — challenging him, Dijols said only, “It’s different.”

    So what? That initial determination cannot be conclusive or non-rebuttable, since the statutes specifically provide that the PD cannot represent someone who isn't indigent. If the PD's office goes into the jail and TELLS people to fill their affidavits full of zeros, they're suborning perjury. If, as seems to happen with surprising frequency, the defendant has private counsel on one case or a VOP and the PD on another or the substantive offense or vice-versa, they're OBVIOUSLY not indigent and for the PD to continue representation is to perpetrate a fraud on the court and the taxpayers, as well as to do a disservice to those of their clients who actually ARE indigent by depriving them of time and resources.

    Two weeks later the private lawyer withdraws because the client has no more money to give and the PD is appointed on both cases anyway.

    Private counsel takes the easy case, the v.o.p. for example, and leaves the P.D. with the real work, the substantive, the first degree felony, etc. He gets the fee for no work!!!
