Judge Ireland will rule at 1:30 PM on two Motions for Disqualification filed this morning. The relevant facts:
"1. On January 9, 2009, after the conclusion of a routine calendar call, Assistant Public Defender Meritxell Ros made a comment to this Court that many trials were set for the following week.
2. In response, this Court went off the record and said "if you haven't noticed my New Year's resolution is no more sob-stories."
3. After Ms. Ros said she did notice the change in attitude, this Court stated that if a Defendant loses at trial "it's an adjudication."
4. After Ms. Ros stated that an adjudication after trial may be reasonable, this Court stated, "and they're going to jail."
5. As Ms. Ros and this Court continued talking, this Court stated "if you lose on a DUI, you're not getting 'first mins.'"
6. Ms. Ros then asked this Court if a Defendant were to lose on a constructive possession of marijuana case would this Court impose jail. To which this Court responded if he is found guilty "he is going to jail.""

Judge should not be allowed to go off the record. All courtrooms should be electronically recorded. Every word should be recorded so judges and lawyers can't wink and nod at each other to cover their butts. If this pd hadn't been an honest lawyer this would have been swept under the carpet because it was off the record.

ELYRIA, Ohio (Jan. 13) - Although a teenager's obsession with a violent video game may have warped his sense of reality, the boy is guilty of murdering his mother and wounding his father after they took "Halo 3" away from him, a judge ruled Monday.
"I firmly believe that Daniel Petric had no idea at the time he hatched this plot that if he killed his parents they would be dead forever," Lorain County Common Pleas Judge James Burge said.

Regarding the "Freedom of Expression" YouTube offering, to the left, by Tom Trento, these Palestinian sympathizers have absolutely no "right" to utter their "fighting words" and then menace, with physical movement toward, the pro-Israel folks.

I'll accept Israel's right to defend its people, with lethal force if needed, I don't have a problem with that, but I wouldn't take either sides comments as being entirely truthful to be honest, they say the first casualty of War is the truth, that's possibly something that needs to be considered by Anonymous at 4:27 as well.
My real pity, however, is with the Palestinian people, Hamas don't really seem to care about their fate, and Israel are being too over-zealous in their shelling for my tastes. UPDATE: We often opine that the ides of January are the worst time to try a case, as prosecutors and judges are busy working on their new year's resolutions to send more defendants to jail. Now comes this from the Broward Blog that North of the Border Judge Ireland has confirmed that indeed her new years resolution was to send more defendants to jail. "No more sob stories" she roared in court the other day.
How many times does an appellate court need to remind a trial judge that YOU CAN'T HAVE A POLICY OF SENDING EVERY DEFENDANT WHO LOSES A TRIAL TO JAIL?
Listen up you robed readers: considering all factors in arriving at a just sentence is what they pay you for. Do you get the fact that any idiot can total up a score sheet and throw someone in prison, but it takes a learned and skilled Judge to arrive at a just sentence?
OK, I realize that the "any idiot" phrase cuts a little too close to home when talking about north of the border. But still, just how long do you have to sit on bench before you start losing common sense? Is it the altitude? Is the daily wearing of black that just eventually blackens your mood? What is it that finally and consistently causes just about any and every judge to eventually lose their common sense and just try and put as many people as humanly possible in prison? Really, we want to know. Maybe you guys need term limits. Hmmm....there's a thought. Put every judge on the bench with the knowledge that in ten or fifteen years they have to go back to being a lowly lawyer.

I agree that there are no good guys in this. Innocent people are getting caught up in the crossfire, and that's never a good thing.
I did see a picture of the boat (post ramming) and they still had the Hamas flag on it. I can't seem to find the link now. All things considered, if you were bringing in humanitarian aid, you might want to fly a more neutral flag on your boat.

if the Bible is certainly true, then if you really, really believe in Jesus and you want to prove to anyone the power of belief, you only need to drink a deadly poison and, according to Jesus, it will not harm you.

Some of these clowns need to go. Being a judge one should be able to expect certain requirements. One of them is to act judicially. She has failed this litmus test. Nobody ever thought she was very bright, but this sort of behavior coming from a judge either in Broward County or anywhere else is completely unacceptable. I don't are whether she is now crying over this mistake or not. She should have known better. Does anybody know when her term is up?

Many courtrooms are electronically recorded and judges have control of the record going on and off.
Besides, there are some judges AND attorneys who do still run their mouths knowing full well the record is on. It doesn't stop them.
