Today's episode concerns a preposterous PC Affidavit, a rock (no, not a cocaine rock, a rock as in a "VALTOX tested positive" stone
), a negative lab report, and, drum roll please, felony charges for one Anthony Bellamy.

Don't worry.  Mr. Bellamy is ok now.  Heck, he might even be better off after the lawsuit, having spent roughly six weeks in the Broward County Jail because of, at best, Satzian incompetence, or, at worst, Satzian malfeasance.

WEDNESDAY NOTES

Judge Rodriguez-Powell takes a cue from Stanton Kaplan Tuesday, requiring an overzealous prosecutor to apologize to the jury for her inappropriate remarks during closing argument.  It all led up to another not guilty for the Public Defender's Office, after the SAO wastes two days on yet another cocaine residue trial; Judge Robinson grants a JOA Tuesday after the police officer can't identify the Defendant, instead pointing to some guy in the audience; Jail population hits 86% of capacity at the end of last week.  It was averaging 98% before there was a full time magistrates judge.  Imagine if there was consistency on the weekends too...

RETRACTION: THE AFOREMENTIONED ANECDOTE ABOUT
THE APOLOGY IN RODRIGUEZ-POWELL NEVER HAPPENED.

Here's what did happen: an objection was raised & sustained.  Sidebar, the ASA immediately took responsibility and volunteered to correct her statement in front of the jury. 

THE ASA DID THE RIGHT THING IN A VERY PROFESSIONAL MANNER.

OUR APOLOGIES TO THE ASA IN QUESTION, THE BROWARD STATE ATTORNEY'S OFFICE,
AND JUDGE RODRIGUEZ-POWELL.

    Ummm..so whats the problem? The charges were filed before a negative test by the lab....and it was approved before a negative by the lab. That's why they have a lab, because field tests aren't always 100%....grasping at straws are we?

    BTW, the initials on the front page of the information are Jules Cohn's, not Horn's, i.e., something happened inside FCF for this to go to Horn. I just don't know what to say: outrageous doesn't even begin to describe it.

    For filing a STONE as Possession of Coke? My understanding was that SAO policy was not to file felony drug cases until they have a lab report, period. My unsubstantiated guess is the guy has a lengthy record and was about to be ROR'd for the State failing to timely file, so it went to Horn from the regular assigned filer.

    How this is NOT a blatant perjury case against the FLPD officers is beyond me. "Valtox positive," my a$$.

    It’s inconceivable the disregard for protecting little children that this judge exhibited today. I have witness tohers seeking restraining order with far less convincing evidence than this case. I am at lost of words and will here. I am not sure who this judge is as her handwriting is very bad. Look like Greenhawdt to me.
