GRADY GRUDGEMATCH: MILIAN vs. DIAZ
Attorneys Al Milian and Rhea Grossman have filed a Motion for Disqualification
in the former Deputy Charles Grady case.
Check it out here.
The allegations:
1. Diaz refused to set a quick change of plea after the Information was served on April 2nd, which the parties wanted since a plea agreement had already been negotiated in the hope of avoiding prolonged media attention.
2. Diaz became "irate, unreasonable and rude" when asked to reconsider, and he refused to allow another judge to handle it.
3. Grady had been hassled by Diaz during a trial of an Hispanic drunk driving suspect.
4. Diaz displayed Milian's booking photo after his arrest for drunk driving, "indicating a lack of respect for attorney Milian."
The change of plea is currently set for May 13th, although the Clerk's website conveniently fails to display the date. The court file still does not contain a police report.

I love this blog. Thanks to you all.
Grady is a piece of crap who has bathed in his arrests like they were roses and cream. He has caused so much hardache for not only the innocent ones he pulled over but for the poor girls he harassed. This is a sexually motivated crime so his little white police ass better hope he never goes to jail. Now, without the badge to hide behind how much time will it take before he molests someone or we catch him lurking near his neighbors window. Please tell us the date of his plea, I am sure all the defense attorneys would love to pay him a visit.
Sounds like another free pass for a bad cop in Broward.
Hey - maybe Diaz won't accept the obviously going to be no jail time plea from the state and force a trial?
That's a good way for Diaz to get his name in the paper on a popular cause in case someone runs aginst him but I bet he disqualifies himself.
I think he could deny it as legally insufficient based on Grady's affidavit.
It doesn't really matter what Diaz does in this case. His seat is up in 2012.
Bob, who is as old guard as anybody including Ross, Spechler, et al will either retire or face an opponent.
Bobby Diaz apparently tried to skew a trial in favor of a hispanic.
Deputy Grady was a good man who made a mistake but locked up many bad people.
How dare my blog speak iin favor of Diaz
Let's not forget what he did to a good kind and understanding fellow county court judge. Rememner he was fined and suspended for his conduct.
Big hello from Ashville
ADJ
Bye Bye Robert
What a shame that a judge has to allow a case get this far. Didnt they all learn from Aleman. Diaz you are up next before the Supreme Court.
I know that is Grady in the photo, but who is the ASA that he is searching???
Diaz hasn't come up for air since Dejols bit the dust. Still barricaded in the bunker until now. Don't know what he thinks this newest development will do but bring attention to him which probably isn't advisable in his position.
Is that a picture of Greenhawt? Sure looks like her.
He's got opposition for sure next time up. You'd think he would have learned something when he got stung by the JQC for his last stunt. Some people never learn, but Diaz is a real slow learner.
What's the beef? Diaz gave a scuzbag cop a hard time? Milian wants him off because Diaz may actually give Grabbags Grady what he derves.
I'll vote for him twice.
You may be the only boob that votes for Diaz, but you'll be the only vote he gets. He's out soon. Sounds more like Donut Boy at it again to me.
What's all the hoopla about Diaz? He'll get run against and tossed out like Dijols. Just watch.
As has been seen for many years, judges circle the wagons when it comes to any of them getting opposition. Only as has been seen, the Indians have punctured a rather wide hole in their defenses. It's like Custard's last stand for Diaz if you ask me.
The judges haven't circled the wagons around their brethren getting opposition since the Ross & Co. era. Vic inspires a "me first" attitude amongst his fellow jurists.
And by the way, the guy's name was Custer you moron.
guess laura was working late at the charter school yesterday leaving u time to blog....we all know anything good about diaz gets u going.
don't worry about bob in 2012 worry about yourself (no need to contact leo or fbi) in 2010 campaign. opponents and more campaign fun then you ever imagined.
Would be a good name for a bar. Or maybe an early-90's retro grunge band.
Diaz irate, unreasonable and rude? Imagine that. Milian knows just how to deal with errant judges. Like maybe running against them to start with. Maybe Milain should have shown Diaz the JQC findings and the resultant discipline and fine imposed on him for something a bit more interesting to voters next time up for Diaz.
The plea will most definitely be probation as Liz will easily convince her friend Lee Cohen to agree to no jail for her ex.
Lee, appropriately, has nothing to do with this case, which is being handled by the Special Prosecutions division of the SAO, not by County Court.
Diaz should just kiss it so long! We need some good judges around here, not the appointed kind.
Milian and Diaz should settle it the old fashioned way with a punch-up after school. Like the way Ty Terrel/Milian did it. Someone can take bets on it too although I don't think anyone would bet on Diaz.
Seidman, why is it that, whenever you see the word "diaz," you salivate like Pavlov's dog?
Don't you realize that every time you bring up your past with him, people start up talking, again, about your paranoid behavior in your courtroom, past and present? Your blogging about Judge Diaz ALWAYS brings the discussion back to you.
By the way, your buying off Kulik only serves to humiliate Kulik and everything some people mistakenly thought he stood for. I don't know if any attorney of integrity is considering a run against you, but why would he or she be concerned about your new political buddy?
Your BS has nothing to do with the Grady matter.
Milian's motion has backfired. Thanks to this blog, the Grady matter now has a new life. No judge, whatever the level his or her ethics, would be stupid enough (I think) to let this case slide through the system. This case, thanks to Milian, is just too big for the public to ignore. Milian may have thought he could pull this off, but now he has created a can of worms that has burst its seams.
What does any of this have to do with Diaz getting opposition and learning the hard way what several others have learned about these positions? If he had been up the last time with his buddies Dejols and Avalos, he would already have passed into the realm of throughly forgettable by Broward Judicial standards.
This is but another example of the kind of stuff that got him into trouble with Seidman and the JQC with the resultant repremand and fine of fifteen thousand dollars. Diaz simply doesn't know when to stop. All this from a judge that has never faced opposition. But I think the time is at hand for Old Diaz. He's racked up to many judicial strikes agaist him. Now's the time to take him off the bench all together. It'll be a hard lesson for the twerp and he'll play the blame game against Seidman, but Broward would be much better off without him on the bench.
Diaz may be rude to lawyers but he is a good judge. He doesn't kowtow to the state and he isn't afraid to grant motions when the cops lie lie lie.
Milian knows this too. He doesn't want Diaz because he knows the whole Grady case stinks to high hell. The state wants to let another dirty cop go and Milina wants a judge who will let it happen.
The whole thing is so obvious.
Thanks Bob. Now get ready to join the ranks of your old guard friends, Bob Zack, Larry Seidlin, Jay Spechler, et al. Is Ross up in 2012?
2012 is going to be a fine year.
Bob Diaz has been a terrible judge. Rude, arrogant and lazy are the words the come to mind. Diaz has now done it to himself. There are plenty of judges who would have taken the agreed plea between the State and the defense. Bob, in usual Diaz form, saw this as an oppurtunity to f--k two people he doesn't like (Grady and Milian) Judges aren't suppose to be that way. I suspect Bob will be retiring early, just like his good buddy Bob Zack. Hey, does anyone know what Zack is doing these days? Does he play tennis with Larry Seidlin? Or Golf with Wayne Spath?
