IT'S UP TO TOBIN, BUT DON'T HOLD YOUR BREATH

We just spoke the the Supreme Court Clerk's Office.

An order has been issued in Loureiro.

The Agreed Motion To Vacate has been granted, with a twist.

Here's the Order:

"The "AGREED MOTION TO AMEND MARCH 31, 2009 RELINQUISHMENT ORDER TO RELINQUISH JURISDICTION TO THE CIRCUIT COURT FOR THE SEVENTEENTH JUDICIAL CIRCUIT (BROWARD COUNTY) SO THAT AN AGREED MOTION TO VACATE THE SENTENCE AND CONVICTION CAN BE FILED AND A NEW TRIAL ORDERED" is hereby granted and we issue the following revised order in place of the order dated March 31, 2009.  We hereby relinquish jurisdiction to the Seventeenth Judicial Circuit in and for Broward County, Florida and appoint the Honorable Victor Tobin, Chief Judge to consider the Motion to Vacate the Conviction and the Sentence of Omar Loureiro and Order of New Trial and we hereby relieve the Honorable Lucy Chernow Brown, Circuit Judge, of the Fifteenth Judicial Circuit of Florida from any further relinquishment responsibility. (Emphasis added)

If the Motion to Vacate the Conviction and Sentence of Omar Loureiro and Order of New trial is granted, counsel for Mr. Loureiro shall immediately file a Notice of Voluntary Dismissal of his pending appeal in case SC0-1799 with this Court."

Basically, it's up to Tobin.  If he agrees, it's vacated, and a new trial will be awarded with no further inquiry.

It's unclear what would happen if he says no, although that seems highly unlikely given the political nature of the Broward Judiciary.

    I mean, we all know that Ross covered for his cronies and the other judges and that is one of the reasons he was able to stay in power for as long as he did.

    But letting this one slide seems to take the case.

    If he holds a full hearing, and Alu, Cacciatore, the other people at the table that night, come and testify, and we get something meaningful, I'll pay tribute at the Tobin Shrine.....

    But if he doesn't, it's just more proof that

    I doubt Tobin will set it down for hearing. To do so, would be to throw Gardiner and Scheinberg under the bus.
    Vic is NOT going to do that.

    We all know Holmes and Gardiner are really good buddys. If it is any consolation, Holmes isn't getting US Attorney. Bottom line Vic is no savior. Vic is not as bad as Dale Ross (that's setting the bar really high) but Vic is still part of the old guard.
