Grady Ordered Into R.E.A.C.H. - Judge Robinson signed the following order today:
The Court having heard the testimony of Dr. Michael Brannon as to his evaluation of the defendant, Charles Grady, orders the defendant Charles Grady to commence outpatient treatment at R.E.A.C.H. in Davie, Florida until further order of the Court.
The case was set for hearing today by the SAO on the following Motion:
State's Motion To Compel Production of Psychological Evaluation, Or Alternatively, Motion For In Camera Review of Psychological Evaluation ...
Apparently, Grady's lawyer Al Milian didn't want to turn over Brannon's evaluation to the SAO, Probation, or BSO. From the Motion:
4. To date, Alberto Milian has refused to produce a copy of Dr. Brannon's psychological evaluation to probation or BSO ...
Schwartzreich & Glassman Strike Again - Today Judge Lazarus and a jury cleared a single mother of two of seven, count them, seven charges of DUI/DUI Property Damage. Defendant Lauren Dunn was cleared by JOA on four counts, acquitted by jury of three more, found guilty on an expired tag, and pled to DWLS. Pretty amazing work, considering the Clerk's Office shows one of the jury acquittals as DUI Above .20.
CORRECTION: THE CASE WAS A REFUSAL - THE CLERK'S OFFICE REFERENCE WAS DUE TO AN ENHANCEMENT FOR CHILDREN IN THE VEHICLE, NOT A .20 BLOW

I think it is for sex counseling and focuses on victims of sexual abuse. That would explain a lot. I don't think the contents of the evaluation that are reduced to writing and in the form of a written opinion by an expert are subject to privacy rights due to the criminal case especially if it is a condition of probation.

Good job Schwartreich, but lets not forget to mention that Steven Plant has been to trial twice in the last two weeks on second degree felonies and twice the jury has agrred to lesser misdemeanors in both trials. One sentenced to time served of two days, petty theft, down from a robbery.

Schwartzreich & Glassman and Judge Lazarus have succeeded in putting another irresponsible driver back on our streets. Lauren Dunn cleared and aquitted of 7 violations including DUI. When/if she repeats these offenses and kills someone, she will again walk because it will be regarded as her first offense. MIchael Haligowski was killed by evinson duprat who was DWLS, no insurance, borrowed/stolen tags, ran a stop sign, made an illegal lane change,and failed to give right of way. There was also a warrant out for his arrest for DWLS. Michael died alone in the road. Duprat and his 4 teenage passangers were not drug tested. Duprat walked out of court with community service and a grin on his face because some of his 6 previous DWLS violations were cleared or aquitted. No serious consequenses. So dear lawyers and judges pocket that money you earn and dodge the drivers you put back on the streets. S Florida is one of the most dangerous places to drive in the U.S. The DMV and AAA have statistics to prove it. Yeah, I've heard it before from Lee Cohen "lawyers are entitled to earn a living". At the expense of our children and loved ones? I think not. Laws will someday be passed to protect the public from driver that should be taken off our streets and judges and lawyers who put their pocket change above the lives of innocent people.
I think the problem is the mindset of the SAO.
The managers and the lifers exist for one reason, ie to make a lot of money and do no work.If keeping our streets safe was important to them then the seasoned trial lawyers would be trying the important cases like guns and DUI instead of inexperienced kids who do the best they can against much more experienced lawyers. At the very least they could assign lawyers with 10 years or more to sit with the kids who try the cases (but that would cut into lunch).
There is little wonder the SAO loses so many trials. Someday maybe the public will wake up to it.

Lets hope it wasnt a seasoned lawyer taking advantage of going against a less experienced lawyer bc that would not be justice. Im curious to know what happened... Of course. You must not be an attorney to ask that question. The State's ethical duty is to seek justice. Defense counsel's ethical duty is not: it is to be a zealous advocate for their client (within the limits of the law) and achieve the best possible outcome for them.

makes sense. It does seem retarded (again sorry for the un-p.c.) that the state doesnt use more experienced attorneys for dui's. To me, dui is more serious/dangerous of an offense than possession of certain drugs. Especially when their stated goal over and over again is public safety.

To 6:18 pm 7/1: Why do you "blame" the defense lawyers (and judge) for putting another "dangerous" driver on the street? Why would you attack the defense lawyers (and judge) for "doing their job" instead of attacking the prosecutor for "NOT doing their job?" Defense lawyers win when there is insufficient evidence of guilt (in which case they "should" win), and when the prosecutor blows the case. If the prosecutorial machine of government, better funded, with more investigative resources and technology, and the law on their side, can't win a case, then the case is a loser. Blame the system if the guilty go free, not the conscientious defense lawyer doing what law and ethics require. (P.S. Don't believe everything you read in the newspapers and police reports, either.)

There is nothing true about that statement at all. If it was better funded the state would have schwartzreich, ivashuk, bogenshutz, dutko, kroll, etc. etc. etc. prosecuting cases, instead of kids barely out of law school (sometimes still in law school). The state and public defender pays its lawyers peanuts and its secretaries peanut shells. i find it hard to believe that the secretaries can afford to live in broweird with those salaries. What they get paid is almost a crime.

If you were an attorney, you would know that better that anyone--every other attorney does--even the dishonest ones. and in fact, if you call Bill McCollum's office, his staff will tell you the AG has a constitutional duty to defend any and all appeals of convictions no matter how illegally, unethically or fraudulently obtained, but if you ask if the AG's duty to seek the truth supersedes this constitutional duty--toy will be brushed off--you will not be given a direct answer.
