RIP Frank Lee Smith: An Innocent Broward Man Who Died on Death Row

4. The police detectives and the attorney told me the man had a scar under his eye. I never saw a scar and they knew that. The state attorney told me that the man on trial had committed several crimes just like the one that happened near my grandmother's house. The state attorney also told me that the man on trial was dangerous, guilty of the crime, and needed to be taken off the streets.

5. While I was in the courtroom telling about what I saw, I knew that the man on trial was too thin to be the same man I saw on the street. The police detectives and the state attorney put so much pressure on me to testify against the man on trial.

6. The state attorney told me not to worry about my testimony because the man would be locked up and electrocuted the following May. He also pointed out the man's entire family to me. I was just feeling so pressured.

                              ROC Last Week
(although you'll find the same in almost every Broward courtroom, any day of the week)

The "Primordial Urge" defense - a lawyer plans on trying a consensual sex with a minor charge soon (+16), looking for a jury pardon.  What's the angle?  "Technology has outpaced evolution".  Here's how it goes: "Once upon a time, the mother of your child had to be young and strong to survive the ordeal of childbirth.  The mortality rates for both mother and child were brutal, before modern medicine.  Of course, we're way beyond that now, but the fact remains that men are still genetically programmed to find late teen gals extremely sexy ... "  Will it work?  We'll let you know ...

JAABLOG SOS! - are you a capable Apple Desktop Publisher?  We need someone to come up with some professional looking flyers for distribution to defendants, jurors and other members of the public in front of the Courthouse.  They've got to look good, since we hope to draw many more layperson eyes to our humble blog.  If we're going to finally rid Broward of yesteryear's misguided detritus, we need your help.  Please send us an Anonymous Tip with contact info, and a quote for how much your bang-up design job will cost us.  Your anonymity is 100% guaranteed.

Is it true? - did the SAO really fly in a witness from Israel on a misdemeanor petit theft? We heard the story today, and have pretty much confirmed it.  The problem is that it happened a year or two ago.  Should we follow up, or is the story stale?  Maybe we'll ask Anthony Caravella and the rest of the innocents, who obviously didn't have a blank check (or an SAO nickel) when it came to the SAO investigating their cases ...

Who's your Daddy? - hopefully it's Mike Satz, who would let any of his kids (if he had any) stay up all night eating candy and watching R rated movies, and then sleep through school the next day.  Seriously, how ridiculously obvious is the public corruption in Broward, when clowns like Eggelletion and Gallagher are allegedly selling their souls for chump change, and stuffing it in doggie and golf bags to boot?  Still, we're awful happy that the public is finally starting to see Satz for what we believe he is, namely a blatantly self-interested politician who knows it's politically expedient to kick the living crap out of poor people, while turning tail in the face of the powerful crooks who could do him harm.

And how embarrassing for "Iron Mike" that the Feds snubbed him?  What does it mean?  Is it possible that his office has somehow been implicated in the probe, which has now touched on his pals in the
Book and Scherer empires?  Or did they shun him because of his legendary tolerance for public corruption, as the Sentinel's Mike Mayo wonders?  No one can say for sure, although it's a safe bet this one's going to be the ride of a lifetime for old Mike, particularly following so closely on the heels of his pal Ken Jenne's bust.

The Broward Difference - corruption, stupidity, greed and dishonesty are part of political life EVERYWHERE.  Stupid people with low self-esteem can't help it, just like they can't help running for office in the first place.  The Broward difference?  Here, while the rich, powerful, or badged openly violate the law without consequence, the criminal justice system turns around and beats poor minorities with sadistic zeal on even the most petty offenses, hypocrisy be damned.  It doesn't happen in other major metropolitan areas, AND IT NEEDS TO STOP RIGHT NOW IN BROWARD.

What's wrong in Repeat Offender Court? - Why does it seem that everybody diverted for special prosecution by the SAO is African-American or Hispanic?  And why are Career Criminal ASAs being saddled with cases they can't prove?  Is anybody minding the store since Mark Springer retired? Constantly developing ...

This and that - we've got a coupler of killer PC Affidavits in the pipeline, hopefully ready for delivery tomorrow;
Here's the Daily Mail Story on former Rolling Stone Mick Taylor that all the classic rock DJs have been clucking about for the last couple of weeks;  And from the Best Response Department: Q - "Did you win your trial?"  A: "The case is currently on appeal"; Click here for the DBR's Jordana Mishory's scoop on yet another juvenile defendant (#3) peeing himself before Judge Feren (not because the Judge drew to an inside straight, but because Chief Judge Tobin won't offend a more senior judge by sticking him or her in Feren's bathroomless courtroom).

On Thursday, Broward State Attorney Michael Satz's office denied claims that it was uninvolved in Wednesday's arrests.

At a press conference Wednesday, Sloman said there had been ``no coordination'' with the State Attorney's Office, ``but I wouldn't read into that at all.'' However, Satz's critics did read into that a slam against Satz, who has been accused at times of being soft on elected officials.

Tim Donnelly, who heads Satz's public-corruption unit, disputed Sloman's characterization. ``We were not shunned,'' he said. ``It's unfortunate the impression is that we were not informed or did not provide any assistance. We have a great working relationship with the U.S. Attorney's Office and provided whatever assistance they required of us.''

He said Satz's office provided assistance in all three cases, but declined to give details.

John Scherer did not become president of Gulf Building until January 2009 when he took over the (then) bankrupt company. His name was thrown in that sun-sentinal article so that stupid people will jump to stupid conclusions. Get a grip. The Scherer family is really not that interesting.

    The Scherer Connection

Neither Scherer returned phone calls from the Pulp. Again, neither is implicated in the federal investigation and there is no indication of wrongdoing. But it sure is interesting where Bill Scherer turns up. This year he's been in the news when his son-in-law, Anthony Mercer, was charged with drug crimes. Mercer's felonies magically turned into misdemeanors, much to the dismay of the folks at JAABlog, who suspected Bill Scherer's friendship with State Attorney Michael Satz might have influenced the hand-slap. Then there was the case of pervert BSO deputy Charles Grady, who also seemed to have gotten off light after it was learned he was sexually assaulting female detainees. Grady, it turns out, had been dating Bill Scherer's daughter, Elizabeth, who is also one of Satz's favorite prosecutors and was the wife of Anthony Mercer. (I know, it's a soap opera, right?)
