SUNDAY NOTES - "VAGINA JUSTICE"
No further continuances - Will Judge Ana Gardiner be chucking it in before the New Year? That's the buzz, growing stronger everyday. The real question, of course, is whether she'll quietly disappear into the night, or go out with a bang. Let's hope it's the latter, since no one heats up the blogosphere quite like our Ana.
And where has Gardiner been? There have been very few sitings in recent weeks, including a major no-show at Saturday's Puerto Rican Bar Association's Seventh Annual Gala. Gardiner missed out on Florida Supreme Court Justice Fred Lewis' speech, which highlighted some of the Broward Bench's past achievements, including "Crying Larry", "Pot Head Korda", and an unnamed judge or two known for making racially insensitive remarks. What a shame that she wasn't there to stand up for the 17th, after all her contributions to the Circuit's everlasting glory.
A very busy JQC - rumor has it that the JQC has been all over the Courthouse of late, for reasons other than the obvious ones. Does it have something to do with the upcoming 2010 election? Or is everything tied together? Wait and see ...
ZZZZZZZZ - As expected, the JNC sent the same names Friday to replace Judge Vitale to the Governor that he's currently perusing to replace Judge Carney. The six names are: Maria Schneider, Raag Singhal, Chris Pole, Julio Gonzalez, Michael Usan, and David Haimes.
Bradygate Update - we've got tons of this stuff, and it's coming your way. Also - expect a major missive from Public Defender Howard Finkelstein regarding the scandal, hopefully this week.
"This is not vagina justice" - Broward may have been an early proponent of Mental Health and Drug Courts, but Vagina Court is not on the horizon anytime soon, at least according to Judge Ian Richards. During a hearing last Thursday in State v. Mullen, the good judge declined to issue a warrant to take Ms. Mullen into custody for violating a no-contact order and for not appearing (her counsel was also not available Thursday, due to a hearing in Federal Court). The alleged victim, a man, was upset, letting the judge know that he believed the order would be issued for a male defendant, while his alleged abuser was getting special treatment because of her gender. Richards calmly explained that he doesn't like taking anyone in before case disposition, slipping in the aforementioned "vagina justice" statement amidst other comments refuting the claim that he's biased in favor of women. Observers in the courtroom were reportedly shocked by the term, but not surprised when Richards made the right decision regarding Mullen's freedom both on Thursday and on Friday, when Mullen and her lawyer Jaime Benjamin were both in attendance.

Lucky for Ana all this Rothstein stuff is going on. She should quit now, if that's what she intends to do. It'll go unnoticed in the RRA media storm. I imagine she wishes RRA was still in business though. She could have worked there after all.

Rothstein and his connection to contributions to politicians, including Broward's Best Schemers is the worst part of this nightmare.
He continued to grease the palms of local politicians and judges while pulling off this hype-scam while all that received contributions looked the other way and much worse.
They should all serve out their sentences together wiping each others mouths with dirty paper towels after they've scrubbed the floors of their cells.

is this richards guy kidding me??? first, he's a superhero (or so he thinks he is), now he's making inappropriate comments on the record. MAYBE he should spend a little more time learning the evidence code and keep his big trap shut.

If Bob Norman is correct about Gardiner's truthfulness in the depo, should she still be a judge? If the answer is no, should she then be allowed to practice law?
Richards has made his bed. Now he's got to make it stick.
It's about time the JQC did its job. Its one of the reasons we've got so many bad judges in Broward County.

I will take vagina justice over human torch any day of the week. Interesting how Ian's comments brings such ire and the Seidman's brings very little. Its Broward I guess and that is why so many blacks go to prison.
If I had to guess about Gardiner, I think this has been going on way back to the judicial conference involving the scandal with Former Judge Julian. Running into the back of a car at a party she wasn't invited to while spying on a boyfriend later didn't help either. But we've seen in politics, particularly in Broward, just what it takes to get someone removed and I'm not convinced of it at this point.
If Alu was wired when she had the conversation with Gardiner and Scheinberg and Charlie Kaplan, she's done though. Who knows at this point.
That's the problem with the way the JQC tries to keep everything secret. I'm not in favor with the way poor judicial behavior is policed by them if it's policed at all. It's entirely too political and judges from this circuit shouldn't sit on it when it involves other judges here. It sure was strange how Scheinberg took off form the SA's office though. Even stranger that Rothstein who made a specialty of hiring fallen judges has hit the pavement. Even from a cursory examination of the facts, this town and those involved sure are attached at the hip when it comes to playing the political favors game. I hope they can get it all flushed out while the FBI is here.
Neither comment, "human torch" or "vagina justice" is appropriate. Of course, neither seidman nor richards belong on the bench.
