Are you really comparing weed to crack? I'm against residue cases too... But are you really comparing weed (not physically addictive) drug to CRACK!? I mean really? Are you for real?
Weed residue vs coke residue what's the difference? A drug addict is a drug addict.
The difference is that one drug is physically addictive and can destroy a person and make them do anything for their next hit ( remember pookie on new Jack city?) and the other can give you the munchies. You can not compare the two.
They don't file residue cases (powder or crack like Mike) in Palm Beach or Miami. Violent crime is decreasing at a much greater rate in those counties than it does here, despite our dwindling population. Why does the SAO feel the need to load people up with felonies with what is treated as a one day in jail paraphernalia misdemeanor in other places? Is that why there is more crime here? Because of hopelessness and desperation and the purposeful proliferation of poverty? And please, don't start spouting cooked Powertrak stats to say Broward is safer. It's not. Open the paper any day if you think otherwise. They could decide to file residue cases on specific violent bad guys but no. They give everyone a felony and F up their lives.
I agree they shouldn't file them. For most people that is an illness, like alcoholism. But font compare it to weed. Cocaine can destroy families, weed doesn't. You loose credibility for your argument by comparing it to weed. There are plenty of reasons to not file residue cases- resource allocation, they are a hard sell to juries, unfair... Ect. But just don't try to make it seem like weed and crack are equal drugs- they are not.
Mike Satz makes no distinction. Remember "The law is the law" and all that discredited mumbo jumbo? Trafficking charges for non-sellers is a good example. The only difference to the SAO is if someone has political or financial juice (Huizenga and the nearly killed old man, Mercer and the possession charges - yes it was PBch that handled that yuk yuk, Adderley no min-mans). If he believes his own spew he should file residue cases pursuant to statute on every weed case. But you know he won't because that could hit the rich kids too.

That is a valid point but not the SAO's rationale. They say what is quoted above:

He said "drugs" not "cocaine"! Is he saying blacks commit more crime, since mostly blacks get residue cases? Why isn't he raiding college dorms and handing out weed cahrges to everyone with a dirty bong? to all u great attorneys who constantly harp and bitch on the residue issue. have any of you aver defended a residue case, if so..... i hope u gave your client a fair shake.. how many actually did any work on the case and actually filed a motion to dismiss,,, how many of you great legal minds even know what that is... sorry for the sarcasm but this is the third time ive posted this same message. does anyone actually believe the legislature in its great collective wisdom ever intended something that is unusable [cant get one high] to be illegal. it must be a usable amount... a few years ago BSo lab did a study of paper money and found a high percentage to have powder residue, can you see the cops checking every 100 dollar bill for residue.. stop the black argument and do your homework and file the appropriate motion, u might be shocked by the result. i believe the great majority of the sao would like to get rid of residue cases but as long as it says cocaine they cant.

So that's what crack does? Are you serious? You sound like 70 year old Satz himself, taking your cues from 80's movies because he has no idea of the real world.
The truth is cocaine in any form is a killer. But it doesn't turn people into zombies either, except after years of abuse that correspondingly breaks down mental capacity as you go along. It's all about early intervention and rehab.
As far as the BS breaking into houses routine, save it for the campaign trail when Satz and his buddies will need you to trot out the borderline racist fear/smear routine. Of course no one will mention the reality - that crackheads are either sleeping in their own urine on the street, turning tricks or selling small amounts to feed their habit.
That's why the SAO's policies are so destructive. Instead of focusing on early intervention and rehab, they convict and punish, assuring a lifetime cycle of abuse and street level drug sellers. And please don't spout Broward's progressive drug courts - everyone knows Satz fought them tooth and nail and now has the gall to take credit for them.
Residue cases might be appropriate in cases where people have proven recent violent or burglary priors (last ten years, maybe). But to file felonys on every offender is destructive and cruel.

to clarify mike was never married to sherry, she was an employee of the sao and a friend of all. she was married to kenny mikos, a fine local probate attorney at the time.. sherry has since passed but, from knowing her any man would have been honored to be in her presense, and to add, kenny mikos has posted here under his own name till he was attacked by certain anonymous posters, have a great holiday....

As far as the attorneys carrying the ball, why should they? Why is it up to the defendant to prove their innocence on a cheap SAO CYA charge? Why doesn't the SAO just act responsibly? Is it the community's fault that they are too chicken to make a call that other SAO's already have to not file these?

are u saying they do not file because they think its legal,,, or, is it based more on the theme of expediency, too many cases and limited resourses are better spent on other battles, till a court rules a non usable amount is legal, i believe, it will be filed in broward and dam the court dockets..

So it appears Satz had friends who were drug users?
Not surprising, considering he still hires people who used drugs. Just ask any of the lawyers who took the poly to get hired. Some admit to drug use in the past and still get the job of putting poor people away for using drugs.
It doesn't make sense, especially considering Satz's statement that drug users all commit other crimes. It also doesn't make sense that so many lawyers take the money and follow the orders, despite having done drugs too without getting caught.
Doesn't it seem that Satz is giving one class of people a break and the benefit of the doubt (the educated), while showing no mercy to another (poor minorities)?
Another good question to me is did Satz ever hire any drug dealers? How can that be explained if its true?

I do, however, take great exception to your comment about Whites doing less cocaine than Blacks. That is a fallacy and probably borne from your days working in Broward criminal courts. The truth is Whites consume and sell cocaine at levels that greatly eclipse other populations, except they have the luxury of doing it, as you mention, behind college dorm walls and behind the walls of their gated communities.
How sad for all of that we don't have a leader at the SAO. All we have is a man who is content to go along the path of least resistance instead of stopping drugs and crime wherever they exist, even when those same policies wreak carnage on our poorest communities.

But you might be right. Dorm cases might be suppressed because police lies aren't tolerated when rich people are watching like they are when you only have the word of a poor Black guy against a bunch of crooked raiders.
