WAITING ...

You can make the call ... when the transcript arrives.  We're told our favorite newsie is waiting on the transcript from the Lebow/Rossman fiasco.  Absolutely everyone is talking about this one, but, unfortunately, no press was present for the melt down.  The transcript will tell the story.

In the meantime, we're told the Fourth DCA Clerk's office was still in possession of the evidence when the trial was set, and for most of the four day jury selection.  An Emergency Motion was filed with the Fourth in 4D09-2434  on February 2nd, to return the exhibits for the trial.  The same day, an order was issued allowing the materials to go to Broward.

Also - did you know the case was previously tried, ending in a mistrial on September 16, 2008?  It's believed Rossman was also the prosecutor for the first trial.  No word on what happened back then, or why this wasn't resolved with a concurrent plea to the life sentence on the VOP.  Did the SAO make an offer that was rejected by Stone, or, a la the tragic case of Paul Rein/Mazza, is the SAO simply piling on for no good reason?

Hopefully the Sentinel will post the whole transcript.  Many conflicting rumors are floating around.  For example, Lebow gave him more time, and he still refused to open, and, conversely, Lebow was way out of line.  One thing that has been consistently said, however, is the tone of the banter on both sides was virtually unheard of in a court of law.

BBeat: Does Satz Finally Get It?

"The rap against Satz for years is that he is soft on public corruption.  He would argue against that perception.

But perceptions are reality in politics. It could threaten his re-eleciton, unless he does something about it…now.

Satz’s term is up in 2012. 

To be re-elected, he needs to spend the next two years trumpeting every victory his office has over public corruption.  He needs to personally announce public corruption arrests and convictions at news conferences, just like the feds do ... "

    Rossman is just not used to not getting his way. It's the same with all the SAs. When a judge does what she or he knows is right under the circumstances and doesn't do the bidding of the SA in their division, this is what happens.

    But the transcript is not going to make Rossman look like the loser in this one.
