PARKER v. GILLESPIE

Attorney Oliver Parker has filed against Circuit Judge Ken Gillespie.

No return calls, yet - from 4th DCA Judge Dorian Damoorgian, or The SAO.  We left a message to call Friday, and a specific question today, asking whether Damoorgian lent his old friend, Judge Ana Gardiner, a hand (or good word), in her relocation to Cole, Scott & Kissane.  We've been hearing a strong buzz along those lines, but the good Judge has yet to return our calls for confirmation.  As for Satz & Co., it's a stab in the maybe not so dark, based on her old friendship with Mike, and the SAO's one time working relationship with former Top Fed Tom Scott.  Today was the first call we made to the Sixth Floor Boys, so it's still likely that the normally prompt Ron Ishoy will return with a "yay" or "nay" tomorrow.

We did, however, manage to get through the same question to Richard Cole, managing partner of Gardiner's new firm, and also the man quoted in the papers regarding her hiring.  Cole was forthright and gentlemanly, politely no commenting when presented with specific names.  Cole also stated that his firm had completed "due diligence," which included "discussions with (Gardiner's) colleagues, and many other people, both inside and outside the legal community."

As far as any potential Florida Bar hurdles, Cole said "we are satisfied that everything is behind her and us, and are looking forward to her joining the Firm and moving forward."

    Mayor Oliver Parker knows he's the most unpopular person in his own town.
    Looked at that way, Lauderdale-by-the-Sea Mayor Oliver Parker can be thankful. He's only facing a recall petition, an endless stream of insults, and the undying ire of a large percentage of his constituency.

    Parker, who has been mayor of the town since 1998, may very well be the most reviled politician in Broward County right now, per capita. And if you listen to him, the conflict boils down to a couple of time-honored staples of subtropical life, coconuts and bared breasts.

    Those are the first things that the mayor brings up when asked about the issue that is ripping his quaint and unique beach burg apart: The hostile takeover of the town's fire services by the Broward Sheriff's Office.

    The longstanding Volunteer Fire Department was ousted from the town after BSO terminated its contract in November. Parker made the motion and cast the deciding vote to kill the 60-member VFD. The sheriff's office then locked the volunteers out of the town firehouse and commandeered their fire trucks and equipment.

By the time he was an adult and she passed he had a lot of family $. He spent huge money to lose the Republican primary to Elyn Bogdanoff in 2002. He has spent large sums of money on his own races in LBS and even to be a BREC Committeeman. The republican establishment, Scherer etc think he is a lightweight blowhard. He has no ties there. The bottom line is that he has no problem dropping $250k or more and I think will do all he can to make sure the voters know Gillespie is black.     Unfortunately, and especially in the case of Judge Gillespie, the good judges are now paying for the behavior of other judges of the old guard who as we have seen repeatedly exhibited little or no self control in the shenanigans exhibited from the bench and off.

    Through no fault of their own, they are now facing a backlash of a loss of confidence in our judiciary as a whole from within the legal community itself and the public which has led to this onslaught of candidates filing against many sitting judges.

    It's too bad really, or maybe not, but the place may have to be swept completely clean before confidence can be restored.

    Incumbents beware, for the price for such perception will cut deep.

    Because it's not news that elected officials have to face opposition. It was newsworthy when people were threatened to stay out of the races but that story was ignored forever.

    Just days after black lawyers cried out against what they call an ongoing attack on minority judges in Broward County, another minority judge has been targeted: Circuit Judge Ken Gillespie.

    Former Lauderdale-by-the-Sea Mayor Oliver Parker filed election papers Tuesday to run against Gillespie, who had faced no challengers with candidate filings due by Friday.

    Parker is a Republican whose decade as mayor ended in 2008. He made a failed bid for a state House seat in 2004, losing the election by 12 votes.

    By running for Gillespie’s seat, Parker is playing right into complaints by members of minority bar organizations. The groups rallied in front of the Broward County Courthouse on Friday to oppose what they called the targeting of minority judges by Anglo candidates.

    Gillespie, who was appointed by Gov. Charlie Crist last year, is one of five black judges in a county with 90 judges.

    But Parker said the race isn’t about race.

    "I’m not targeting Gillespie because he’s a minority. I’m targeting Gillespie because he’s inexperienced. He shouldn’t have been appointed in the first place," Parker said. "To suggest that I should give him a pass because he’s a minority is the worst form of blatant racism. People should be judged by their qualifications."

    Parker said his experience as a solo practitioner — trying civil, criminal, probate and traffic cases during his 32-year career — better prepares him to serve on the bench. Parker, who sits on the five-member board of the Broward Soil and Water Conservation District, said he would resign in preparation for the race.

    Gillespie did not return calls for comment by deadline.

    Broward County Assistant State Attorney for 3 years. Federal Investigator for more than 2 years with the EEOC.

    If Parker wanted to be appointed like Gillespie, he could have applied for appointment. How qualified does qualified have to be, before its not reverse racism?

Now as far as Mr. Parker goes, I just glanced at ALL of the cases where he has filed an appearance and in over 30 years, he has filed maybe 60 appearances at most. That's about 2 a year. BFD. He says he has tried so many cases. Trial means where you actually present your case before a judge or jury, not plead it out or settle it. I challenge Mr. Parker to actually cite a case where he actually picked a jury. It's called voir dire, in case you forgot the term from law school.
