The prosecution takes a dive - reports are coming in about a young prosecutor doing a face plant before a jury Wednesday. We're told he slid safely into home base after putting the DUI video on for the jury to see, missing a step when making a turn and landing on his face. There were no injuries, just some carpet burn and some embarrassment. The verdict? Not Guilty. (Thanks for the tip, and the lingo)
"We have no jurisdiction" - that's what The Florida Bar told intrepid warrior Jack Thompson, after he complained about all things Gardiner. The Bar wrote him back this letter , explaining that the JQC has exclusive jurisdiction over a sitting judge.
Perplexed, we called the Bar today. Didn't Broward luminaries like Irwin Berkowitz and June Johnson suffer major penalties at the hands of the Bar, for the same conduct that got them booted off the Bench? (See Sun Sentinel: "Berkowitz already faces possible suspension or revocation of his license to practice law because of problems while he was a judge.")
The Bar rep basically told us that disgraced judges can get in trouble with the Bar, but not while they're judges. Quite simply, they don't have jurisdiction until a judge becomes a lawyer again. If a complaint is filed after a judge becomes a lawyer based on the same conduct that caused the JQC to force a resignation or removal, the Bar can get involved and enforce discipline.
There was a major caveat. If the Supreme Court tells the Bar not to investigate or administer discipline, it's all over. If a deal has been struck, there won't be any Bar action.
A few questions immediately came to mind. For instance, if the Bar has no jurisdiction over a sitting judge, can they still negotiate a deal regarding the future status of a judge's law license? Can the JQC negotiate on behalf of the Florida Bar? Can the Supreme Court be involved in negotiations, since both the JQC and the Bar answer to them? Did the Supreme Court have to accept any deal offered to Gardiner by the JQC, or could they have rejected it? And if a deal was struck and accepted, does it ever become public record?
The Bar rep we spoke to today was very nice, but didn't have time to get deeply into the topic. Hopefully the Director of Lawyer Regulation, Ken Marvin, will return the call we left for him today. If anyone can unravel a byzantine mess, it's him.
That's about it. Thanks again to Jack Thompson, for boldly going where no man has gone before. It's believed his complaint about Gardiner also encompassed the $600,000 in legal fees she awarded her new firm before they hired her, as reported by Bob Norman. If that's true, then another issue has presented itself that wasn't in play when the JQC was pursuing Gardiner.
It could get very interesting after May 28th, whether or not Gardiner is eligible to practice law her first day out of the box ...

tobin has no business making everything so damn secret. why would he do that? What does he have to hide? who needs a CJ like this over the judiciary? The gall of that man and how he treats people gives Broward judges a bad rap. He always says one thing and then does another and worse yet does it in the paper! Says he is a man of his word and will give the clerk back his space and what does Tobin do? Harrass the clerk and swipes the space! What a bully! Tobin says he will do judicial rotation and what happens? Very little and nothing with real substance. The Rothstein emails and his off the wall tirades are embarassing to say the least. Now he is having secret meetings!
So does that mean the current Bar complaint against Gardiner could be dismissed without prejudice for lack of jurisdiction and then have to be refiled, the day she is a lawyer again, when the Bar has jurisdiction?

to 10:14--No idiot--it means the bar in typical corrupt fashion is creating excuses for NOT doing anything--the complaint was about gardiner's honesty to practice law. the bar apparently feels that dishonesty as a judge who is also a lawyer does not reflect badly on her fitness to practice law after being openly dishonest as a judge, but no longer a judge getting ready to re-enter the practice of law. This wipes the dishonesty slate clean to the bar. she's the proverbial fart whose stink festers in the world long after she's left the building.

If that's what Breslaw is all about, I want to know more. Public Corruption is what's really bad around here, and few that want to do anything about it.
OK, we know where he stands on corruption, but what is he going to do as a county judge to clean up the oil spill? How about jobs, is he going to create any jobs? Is he going to get our troops home? Why stop at corruption? We need to know his plan of action on the rest of the problems that plague our county and our nation. How am I supposed to decide whether to vote for this candidate for county judge knowing only his position on this one problem, corruption? He needs a position paper or two to get my vote! Whether he knows evidence, or Fla. Statutes, or how much it costs to keep someone in jail per diem, is all ancillary to his stance on corruption.
Where does Judge Robinson stand that is the big??????'s. She is already in the hot seat of judgeship where is her voice on the matter, or do she not fill it is important for her to let the public that she wants votes from . I as a voter would like to hear her stance if she even has one. I want to know why I should vote for her after all this corruption went on , on her watch.
