TUESDAY NOTES
Bowman/Harper - remember the sex abuse allegations lodged by Charles Harper against his ex-foster father John Bowman? It's taken more than eighteen months, but we're told Plantation PD has finally readied the case for submission to the SAO. In that time the troubled teen has picked up at least one new arrest, and the Earth's mean temperature has grown by half of one percent (not really, but you get the point). Also in that time, Bowman's wife Claudette Vanni became the 17th Circuit's newest General Magistrate, keeping up the long standing tradition of JFK amongst the judicial set.
Here's what Ron Ishoy had to say earlier today when asked if the Bowman file had landed on Satz's desk:
"Our office is not in a position to address any specific case that may have been, or may not have been, presented to us.
Speaking generally, if a sitting judge is the subject of a criminal investigation, our office practice has been that we ask for the governor's office to assign the case on executive assignment to a State Attorney's Office in another circuit."

Musical Chairs - questions as to exactly which judges will be moving in January should start to be answered after Labor Day, which is when Peter Weinstein will start meeting with the judges we don't already know about who are looking to be reassigned ...
Diaz supporters can't silence JAABLOG, but who silenced BrowardBeat.com? -
Buddy Nevins picked up on the latest brouhaha involving us and them, namely JAABLOG and the very vocal round table of lawyers supporting Bobby Diaz who hang in the courthouse cafeteria. The incident happened last week, posted by BrowardBeat.com a little before 5:00 PM Tuesday, excerpted below (read L to R):

If you blinked, you might have missed it. The post was gone not too long after publication. No one can say for sure what happened, but it's not hard to imagine a lot of ringing telephones. It's also a safe bet everyone over at Team Diaz breathed a sigh of relief when the article and mounting anti-Diaz comments went dark.
Ironically, before it became known Buddy was even working on the above post, we'd given an earful to the local Sun Sentinel reporter earlier in the day over the paper's blind eye to Diaz's woeful attendance record and shenanigans in the jury room. There wasn't much of a response, understandable since such reporting would have a hard time making it past the editor's pen. Everyone at the Sentinel already knows what's going on, if you can believe one of their very own editors, who stated under oath during voir dire before Raag Singhal not too long ago that she has to read JAABLOG to stay abreast of breaking news (which is typically stolen without credit).
The truth is they just don't care. Quite simply, if the general public was to learn about Diaz's woeful in-court attendance record (which he doesn't dispute, telling Buddy "he is often in his chambers"), Diaz would be voted out in a heartbeat. For whatever reason, most of the local mainstream media has been in the business of turning the aforementioned blind eye to under-performing and even corrupt public officials for as long as anyone can remember, and judging by today's disappearing Diaz post by Sentinel alum Nevins, this particular fact of Broward life isn't about to change anytime soon ...
(But we still love you, Buddy. At least you tried. And don't expect anymore cafeteria fireworks either - a truce has been brokered and is being respected)
Speaking of Diaz - a grand total of thirteen cases on the docket today, resulting in yet another afternoon off. The courtroom was locked shut by the time we were able to check back at 11:38 AM ...
And Speaking of Roshawn Banks - she's mad as hell and not going to take it anymore. Banks told us today she's going to go see Peter Weinstein Wednesday, after we told her Diaz swore in the jurors again this morning. Tinnitus be damned, we could only hear him mention his name two times from our vantage point in the hallway outside the jury room, before late arriving jurors drowned out the rest of his address to the assembled voting masses ...

Nevins has always played politics when it comes to the Birds in Black in Broward. If he ever told the truth about some of these slackers I'd be very surprised. And you can completely forget the Sun Sentinel. They tow the official line of bull crap shoveled out by Broward Judges for years. They simply don't care when it comes to either corrupt public officials or waste of tax payer money. It's an endless trough for these punks.Diaz is just one of the worst examples.

can someone explain to me why lawyers have to watch what they say if the person is a judge?? we can criticize presidents and politicians but not judges? did we give up our constitutional rights when we became lawyers?

Driving is a privilege so is a law license. But the truth is always permissible no matter how much they squirm.

to 1:07pm. Lawyers do not have freedom of speech when it comes to judges or fellow lawyers. See: Fla Bar v. Sean Conway, for one example.

Really? Who does Roshawn think she is??? How does she think that she has the right to approach the chief judge about his decision on who swears in the jurors? Her true character is revealed....
She should focus on herself and her own campaign not on crying over the fact that she is running against a judge who has access to many citizens through their jury service. That's his job.
RE Nevins: this is not the first example of his being bought and sold. I've seen him write articles supporting a political candidate's tactics and then only hours later retracting his support when his neighbor Howard Finklestein walked across the street to inform him that he should change his story. This time it bothered you Gelin..... last time he changed his story to fit your side. You weren't up in arms then. Nevins is useless and untrustworthy. Just a troll that lives on the underbelly of society. A gross little man actually.

Anyone hear of Stephen Finta's passing in late July? Not a word on the blog. He was a fixture around the courthouse for a long time, feeding off the wheel. Even once brought a gun into the courthouse to get out of representing an unyielding defendant. RIP.

Banks needs to file a complaint immediately if she's planning on winning. Politics isn't for babies. Diaz is playing hardball and exploiting every advantage to the max. Weinstein is making it happen for him and won't interfere unless Banks puts on the pressure. Banks needs to demonstrate she's willing to stand up for herself and demonstrate to all she's capable of laying down the law. Watch how quickly Diaz is kept out of the jury room if she follows through.

In chambers? Diaz must think everybody is an idiot. All the guy does after about 11:00 is walk around the halls, hang out in the courthouse cafe acting like he's a Supreme Court Justice or something as opposed to a county court buffoon. It's fairly idiotic, but the guy seems to need attention badly. If he spent as much time working as he does acting like he's a celebrity want to be Broward County would be getting its money's worth. As it is, the guy does next to nothing. Sort of like Seidman used to do only worse and not as smart.

If I recall the judges already tried to stop the blog but couldn't so free speech is alive and well. That whole Conway case was a lawyer calling a judge very derrogatory profane names and Gelin does not do that. He is simply reporting the facts. And my guess is if the judges could have shut the blog down by now they would have done it

Conway case noted how lawyers cannot even "impugn the integrity" of judges, so it's not just name calling that can nab a lawyer, but any time an attorney questions a judge's integrity.
also, in Conway's case, he was trying to expose an illegal practice by the judge - just he chose the public forum rather than the appellate route.
